r <br />~1®~;i~ ~G5~ - <br />SUBDIVISION AGREEMENT <br />CHATEAU ORLEANS SUBDIVISION <br />In the City of Grand island, Nebraska <br />Lutheran Homes, Inc., a Nebraska corporation, Hereinafter <br />called the Subdivider, as owner of a tra^t of Land comprising all of <br />Lot Two (2), Dau Subdivision in the City of Grand Island, Nebraska, <br />excepting therefrom that part deeded to the City of Grand Island, <br />Nebraska, for street right-of-way, by Quitclaim Deed recorded as <br />Document No. SO-0003+2 in the Ha11 County Register of Deeds Office, <br />said tract containing 4.305 acres, more ar less; desires to hate sub- <br />divided as a subdivisian the foregoing tract of land which is located <br />within the corporate limits of tae City of Grand Island, Nebraska, <br />and hereby submits to the City Cauncii of Such City for acceptance <br />as pravided by law an accurate map and plat of such proposed subdivision <br />to be known as CHATEAU ORL"r.nEdS Si`BDI`.'ISIO:~, designating explicitly the <br />land to be laid =}ut and particularly deGcribing the lots and easement. <br />belonging to such subdivisi.>n. with tots designated by numbers and <br />easements by dimensions, and props?sus .o cause *_he plat of such sub- <br />division when finally approved by the etegianal Planning Commission <br />and the City Council to be acknewiedged by such r?waer, certified as to <br />accuracy of survey by a registered land surveyor, and to contain a <br />dedication of easements to the use and benefit of public service <br />utilities. In cansideratian of the acceptance of the plrzi: of CHATEAU <br />ORLEANS SUBDIVISION, the Subdivider hereby consents and agrees with <br />the City of grand Island, Nebraska, that they will install ar provide <br />at their expense the fallowing improvements: <br />1. Residential Development. Lots One (1) through Twenty-three <br />(23) of the proposed subdivision constitute a planned unit development, <br />pursuant to Section 36-27 of the Grand Island City Code. For that <br />reason, the Subdivider agrees that the co..^.tinuing requirements of <br />Section 36-27 of the Grand Island City Code pertaining t<? residential <br />development under the planned unit development will be complied with <br />by the Subdivider. <br />~~ <br />
