If any owner shall fail or refuse to <br />make any payment of such assessments when due, the amount <br />thereof, plus interest, shall constitute a lien upon the <br />owner's interest in his villa and in the property, and upon <br />the recording of such lien by the Association in the Office <br />of the FYegister of Deeds of Hall County, Nebraska, such <br />amount shall constitute a lien prior and preferred over all <br />other liens and encumbrances-except assessments,. liens and <br />charges far taxes past due and unpaid on the villa and <br />except prior duly recorded *~rtgage and lien instruments. <br />Each owner shall be responsible: <br />(1} To maintain, repair and replace, at his <br />expense, all portions of his villa which are not included. in <br />the de€initian of general or limited common elements, except <br />as set forth in Article v, above. <br />(2) To maintain and repair and replace as <br />necessary all utilities within that owner's villa and any <br />damage to the common utilities caused by use within that <br />villa. <br />(3} To refrain from painting, decorating or <br />changing the appearance of any portion of the exterior of <br />the vi12a unless approved by the Association in writing, <br />d. teach villa shall be used and occupied only by <br />one family, its servants and guests as a residence and for <br />no other purpose. No villa may be subdivided into a smaller <br />villa nor any divided portion thereof sold or transferred <br />without the owner first amending this Master Deed in accord <br />with the provisions of the ~Iebrasisa Co:sdc~minium Property <br />Act. <br />e, Na practice or use shall be permitted on the <br />condominium property or in any villa which shall be an <br />annoyance to other owners ar residents in the area or which <br />shall interfere wit2`i their peaceful use and enjoyment of <br />their property. All portions of the property and of the <br />villas shall be kept clean and sanitary and no use thereof <br />shall be made which constitutes a violation of any laws, <br />zoning ordinances, governmental regulations or regulations <br />of the Association. <br />f. Owners representing seventy-five per cent <br />{?5$} or moxe of the total basic value of the then existing <br />San Marcos Condominium as reflected in the Master Deed or <br />Master needs, may at any time in writing, duly acknowledged <br />and recorded, effect an amendment to this Master Deed and to <br />the By-Laxs attached hereto; provided that such modification <br />shall not be binding upon any existing first mortgage holders <br />of xecord unless said modification has the approval of mare <br />than fifty percent (504), in number, o€ the first mortgagees <br />of record upon the data of adoption of said modification. <br />g. This condominium property regime may be <br />terminated or waived only in accordance with the provisions <br />applicable thereto as provided in tze Sy-Laws attached <br />hereto as Exhibit "B". <br />h.
