~1"' 00300'7 <br />MASTER DEED <br />CREATING <br />THE SAN MARCOS CONDOMINIUM PROPERTY REGiP9E I <br />THIS MASTER DEED AND DECLARATION, made this 14th duty of <br />MaY , 2481, by THE SAN MARCOS, a Genera <br />Partnership {herein called "Declarant"). for itself, its <br />successors, grantees and assigns. <br />I. PUP.POSE AND `dAME. <br />The purpose of this Master Deed is to submit the lands <br />herein described and the improvements built thereon to the <br />condominium form of ownership and use in the manner provided <br />by Sections 76-BO 1. through 76-823, R.R.S. Nebraska {herein <br />called "Condominium Property Act"), and the name by which <br />this condominium is to be identified is San Marcos Condomini- <br />um Property Regime I. <br />II. ZNVOLVED PROPERTY. <br />The Lands owned by the Declarant which are hereby <br />submitted to the condominium regime are described as follows: <br />See attached Exhibit "A"'. <br />IZI. DEFINITIONS. <br />Except as hereinafter noted, *_he definitions set forth <br />in Section 76-802, R.R.S. Nebraska, shall Govern this Master <br />Deed and the 6y-maws, attached hereto as Exhik~it "H", and by <br />this reference incorporated herein. <br />a. "Villa" shall mean and include: The enclosed <br />space of each of the seven residential living units shown on <br />Exhibit A hereto and identified thereon as "Villas" by <br />number; all airspace ir. rooms, attics: air conditioning <br />compressors ar units; permanent ray, charcoal burning or <br />electric barbecue uriiis, screening, window glass, exterior <br />and interior doers, but shall not include structural walls, <br />common wails, interior walls, roofs, Floors and ceilings, <br />except foz the unit-side surfaces thereof, which shall be <br />included in the definition "'villa". <br />b. "Condominium" shall mean the entire condo- <br />minium project including all buildings, lani3, and other <br />improvements upon the land as set forth in this Master Deed <br />as a part of the condominium regime. <br />c. "General Common Elements" shall include: The <br />land an which *_he buildings stand, including all of the <br />surrounding lands embraced within the legal description <br />specified in Article Zi above; the foundations, roofs and <br />main walls including the exterior surfaces of all buildings <br />except far screening, window glass and exterior doors; and <br />including all pipes, wires, taps, and equipment located <br />outside of any Villa, but in the Condominium as part of the <br />gas, water, sanitary sewer and electrical utilities systems <br />furnishing those utilities to the Condominium: drives; <br />walks; parking areas; utility buildings, and all parts of <br />the property and improvements which are not Located within <br />tale "Villas" ar denoted as "limited common elements" as <br />shown an the plan which is Exhibit C hereto. General Gammon <br />eJ.sments shall also include all installations and the space <br />necessary therefor of all central services to be provided up <br />to each suite including electric wiring, plumbing, telephone <br />wiring and fS.ues. <br />
