81--U0~142 LICENSE AGREEMENT THIS AGREEMENT by and between the CITY OF GRAND ISLAND, NEBRASKA ,a municipal corporation in Hall County, Nebraska, herein- after referred to as the "City"', and BELL'S CONSTRUCTION, INC., a Nebraska Corporation, of Grand Island, Nebraska, hereinafter referred to as the Licensee, made and entered into this a 1981. WITNESSETH: WHEREAS, the Licensee, as owner, has constructed a garage and driveway on Lot Two (2), Block One (1), Pleasant View Addition, in the City of Grand Island, Nebraska, at the address of 710 Pleasant View Drive; and WHEREAS, said garage and driveway extend approximately eight inches (8"} into the platted eight foot (8') easement on the south side of said Lot Two; and WHEREAS, the City Council has authorized such encroachment into the easement area. NOW, THE.ZEFORE, in consideration of the mutual covenants herein contained, the parties agree as follows: 1. The City hereby grants to the Licensee a license to use and occupy, subject to the terms of this agreement, a one foot (1') encroachment, into the platted eight foot (8') easement on the south side of Lot Two (2), Block One (1), Pleasant View Addition, to accommodate the placement of a garage and driveway located on said lot. It is understood and agreed that the Licensee shall not occupy any of the aforesaid easement for any use other than that stated above without further permission from the City. 2. It is understood and agreed that the Licensee can maintain the building in the easement area above defined at his .own risk. The Licensee hereby waives any claim for damages against the City of Grand Island, its officers, agents, employees, and independent contractors, for any damage or injury that may result to said building being located in the easement area. ;'. 3.
