Such public liability <br />coverage shall also cover cross liability cla-ims of one insured against the other. <br />Certificates of all policies of physical damage insurance and of all renewals <br />thereof, together with proof of payment of premiums, shall be delivered to all <br />mortgagees of suites or garages at least ten (10) days prior to expiration of the <br />then current policies. The cost of such policies shall be a crommon expense. <br />The Board of Administrators shall determine, at least annually, the replacement <br />valc:e of the condominium buildings and, in so doing, may employ such experts as the <br />Hoard may feel necessary. <br />Section 2. Provisions. <br />All policies of physical damage insurance shall contain waivers of subrogation <br />and waivers of any defense based on co-ir.'surance or of invalidity arising from any <br />acts of the insured and shall provide that such policies may not be cancelled or <br />substantially modified without at least ten (10) days' prior written notice to all <br />of the insureds, including mortgagees. <br />Section 3. insurance by Suite and Garage Owners. <br />Suite and garage owners shall not be prohibited from carrying other insurance <br />for their own benefit provided that all such policies shall contain waivers of <br />subrogation, provided, further, that no suite and garage owner shall have the <br />right to insure any of the common element individually. <br />Insurance coverage on furnishings and other items of personal or other property <br />belonging to an owner and public liability coverage within each suite or garage <br />shalt be the sole and direct responsibility of the ~~uite or garage owner thereof, <br />and the Board of Administrators and the Association shall have no responsibility <br />therefor. <br />ARTICLES VIZ. MAINTENANCE RND ALTERATIONS. <br />Section 1. Maintenance. <br />The suite owner shill have the obligation to maintain and keep in good repair <br />the interior surfaces of walls, ceilings, and floors (including capeting, tile, <br />wallpaper, paint or other covering) as well as all fixtures, utilities, wiring, <br />plumbing and appliances, located within each owner's suite. An owner shall not <br />be responsible for repair to common elements by casualty, unless suci~ casualty <br />is due to *_he act or negligence of the owner, his guests, invitees or tenants. <br />All common element maintenance, including lawn maintenance and snow removal, repairs <br />and replacements to the general common elements, shall be made by the Association <br />and be charged to all the suite or garage owners as a common expnese, unless such <br />maintenance, repair or replacement is necessitated by the negligence, misuse or <br />neglect of a suite or garage owner, in which case, such expense shall be charged <br />to such suite or garage owner. <br />Section 2. Alterations but Suite or Garage Owner. <br />Ne sui*_e or garage owner shall make any structural addition„ alteration or <br />improvement in oc to his suite or garage, or the limited common elements pertaining <br />thereto, including any exterior painting or exterior alteration or addition (including <br />awnings, grills, etc.) without the prior written consent thereto of the Boac~ <br />of Administrators. The Board of Administrators shall have the obligation to <br />answer any written request by a suite or garage owner for approval of a proposed <br />struetual addition, alteration or improvement in such owner's suite or garage with- <br />in thirty (30) days after such request, and failure to do so within the stipulated <br />time shall constitute a consent by the Board of Administrators to the proposed <br />addition, alteration ar improvement.
