In consideration of the acceptance of the plat of said <br />LOTS 4, 5, AND b, HLOCK 9, CONTINENTAL GARDENS, the Subdivider hereby <br />~'f?~P3srits and agrees with the City of Grand Island, Nebraska, that it <br />dill install or provide at its expense the following improvea-ents: <br />1. Cortial Development. The proposed subdivision constitues <br />a gunned unit development pursuant to Section 36-25 of the Grand Island <br />City Code. For that reason, the Subdivider agrees that the continuing <br />requirements of Section 36-25 of the Grand Island City Code pertaining <br />to commercial development under the planned unit development will be <br />complied with by the Subdivider. <br />2. Streets. The Subdivider waives its right to object to any <br />paving or repaving district of tdebb Road or Rue de College where they <br />abut the subdivision. <br />3, Water. Drainage. The Subdivider agrees to grade the subdivision <br />baoically in a°~Aordance with the plans on file with the City`s Director <br />of Public Works for the drainage of Continental Gardens Subdivisions <br />prepared by PSi.s Kawamoto, dated January 7, 1475, subject to the <br />final aipproval of the City°s Director r~f Public Works as to their <br />co¢~liance with such plans, and that such subdivision drains to the <br />public right-of-way. <br />6. Sidewalks. The Subdivider, if still the owner of the land <br />in Lhe proposed subdivision, or if tl:e Subdivider shall have trazs- <br />ferred title to the property, then the various Grantees thereof, will <br />install, at their own expense, all public sidewalks required by the <br />and Island City Code when the adjacen*_ Iot is built upon, and <br />side~ralks shall be regulated and required with the building permit <br />for each such lot. <br />- 2 - <br />
