~1-°t~i~l~~~ <br />To West Lawn; Lots One (1) and Four (4} to be served by private <br />service lines through the platted easements in Lots Two (2) and <br />Three (3}; and the Subdivider agrees to canned all residential <br />structures in the subdivision to said City sanitary sewer service. <br />4. Drainage. The Subdivider agrees to grade the lots of <br />the subdivision in conjunction with the structures thereon so that <br />storm water drains to Taylor Avenue. <br />5. Sidewalks. The Subdivider, if still the owner of the land <br />in the proposed subdivision, or if the Subdivider shall have trans- <br />ferred title to the property, then the various grantees thereof, will <br />install, at their own expense, all public sidewalks required by the <br />Grand Island City Code when the adjacent lots is built upon, and <br />sidewalks shall be regulated and required with the building permit <br />for each such lot. <br />6. Warranty. 'T'he undersigned owner, as Subdivider, warrants <br />that it is the owner in .fee simple of the land described and proposed <br />to be known as PEPPER SQUARE SUBDIVZSZJN, and that an sbstract of <br />title will be submitted for examina*_ion, if necessary, upon request <br />of the City of Grand Island. <br />7. This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the parties hereto, their successors, <br />assigns, heirs, devisees, and legatees.
