Psdditionally, the plan also had to be
drawn~so as to accommodate the existing foundation that the house
would sit an--of course,, the original house was destroyed by the
tornado.
with all these variables, it was impossible at the time of the
proposal to calculate the exact square footage of the residence.
Of course, it is clear from the proposal, that the contract price
of $51,600, was based on a 2500 square foot home.
Once the architect°s plan were complete, my client then resubmitted
would
the sal, and included therein, the blue prints whit
ame the peratare portion of the contract. .~tQ~' eli~~ then
o is which called fos a nose with 19a5 square
eat.._ Zt is'our contentwn s i_ n fact becatae the contrae~^
Ta the extent that the origir._L pro ~ sal was incansi ent th~rt th
the architect's plans, and their suasequent construction, established
the terms and conditions of the contract.
Your clients should be able to verify that Marty Galley went over
the plans verycarefull_v with them prior to•their initialing them,
and in fact left the plans with them for two days prior to their
approval. There was na quostion that they knew what the plans called
for, and were €amiliar with the square footage, which is written
very clearly an page 2 of the plans.
At the complatian of the project, Galley Construction. submitted their
final statement, which effectively called for additional payment for
the 19S square feat that was over and above the original proposal
grits. By recalculating the original square footage called for in
the proposal, Galley Construction calculated that the square feet on
the project was bid at $29.57 per square foot, and therefore the
additional square footage was billed at $5,766.15.
Z t29ink if~you will investigate the billing price of a construction
square foot, you will find this well within acceptable standards, and
prrsbably significantly lower than the fair and reasonable price in
tfsa Grasd Zsland ccmmtunity at this time.

J
