<br />reservations, excsgtions and exclusions consistent with the <br />condominium ownership of th? property regime and for the <br />best interests of all of the condominium villa owners, in- <br />cluding Beclarant, in order to serve the entire condominium <br />property regime, and to supplement or amend this Declaration <br />or the attached $Y-Laws until June 30, 1981, or until Declarant <br />releases control o€ ties Association, whichever first occurs; <br />provided any such supplement or amendment shall be approved <br />by all existing first mortgage holders of record,. in writing. <br />Declarant reserves the right until June 30, 1981, to <br />file a Master Deed and Declaration creating Fairway Villas <br />Condominium Property Regime ZI an the real estate contiguous <br />to the real estate described on Exhibit A, upon which filing <br />the Fairway Villas Owners Association shall automatically <br />have jurisdiction over both Fairway Villas Condominium <br />Property Regime I and' Fairway Villas Condominium Property <br />Regime II, and shall operate, maintain, and allocate the <br />common expense on a share and share alike basis among all <br />villas in both condominium property regimes, each villa <br />thereafter having one vote out of eleven and paying 1/11th <br />of the expenses incurred by the Fairway Villas Owners As- <br />sociation. <br />X. EASEMENTS. <br />Easements are hereby reserved and granted from and to <br />Declarant and each owner of a condominium villa for en- <br />crgachment i€ any part of a condominium villa encroaches <br />upon any other villa or the common elements or if any such <br />encroachment shall hereafter occur due to the settling or <br />shifting of a building or for any other reason, or if such <br />building is repaired or rEbuilt after damage or destruction. <br />The Association ehail have an easement in and upon each <br />villa for the performance of repairs upon the common elements <br />and for emergency repairs to any part of the condominium <br />property. <br />XI .
