~„----- -~- 4. INSURANCE AND REPAIRS. TRUSTOR shall maintain fire and extended coverage insurance insuring the improvements and buildings constituting part of the Trust Estate for an amount no less than the amount of the unpaid principal balance of the NOTE (co-insurance not exceeding 84~ permitted). Such insurance policy shall contain a standard mortgage. clause in favor of BENEFICIARY and shall not be cancellable, terminable or modifiable without ten (lOj days prior written notice to BENEFICIARY. TRUSTOR shall promptly repair, maintain and replace the TRUST ESTATE or any part thereof so ,that, except for ordinary wear and tear, the TRUST ESTATE shall not deteriorate. In no event sha,11 the TRUSTOR commit waste on or to the TRUST ESTATE. 5. WASTE. TRUSTOR shall neither commit nor suffer any waste on the premises and shall keep and maintain a.ll buildings, improvements, appurtenances, fixtures, parking facilities and spaces and other property now or hereafter situated thereon in good and substantial condition and repair, and shall not take or permit any action whatsoever whereby the premises shall become less valuable. No building, improve- ment, parking facilities or spaces ar fixtures, now or hereafter situated on the premises, shall be removed, demolished or substantially or structurally altered in any way; nor shall afiy fixtures covered by this DEED OF TRUST AND SECURITY AGREEMENT or any personalty covered by any security agreement given in connection with this loan be removed unless replaced with other fixtures or personalty with a value at least equal to that removed and free from any title retention or security agreement or other encumbrance, noz shall any capital improvements be made upon the premises without the prior written consent of the BENL•'- FICIARY in such event. 6. ACTIONS AFFECTING TRUST ESTATE. '1'RUSTOR shall appear in and contest any action or proceeding purporting to affect the security hereof or the rights or powers a1 BENEFICIARY or TRUSTEE, and steal! pay ail costs and expenses, including Oast of evidence of title and attorney's fees, in any such action or proceeding in which BENEFICIARY or TRUSTEE may appear.
