<br />DEED OF TRUST AND SECURITY AGREEMENT
<br />THIS DEED OF TRUST ANB SECURITY AGREEMENT is made this
<br />day of October, 1980, by and among John A. Albers and Marilyn L.
<br />Albers, husband and wife, (hereinafter TRUSTOR), whose mailing
<br />address is 2012 W. Barbara Avenue, Grand Island, Nebraska 68801;
<br />Kenneth C. Fritzler, Trustee, (hereinafter TRUSTEE), whose mailing
<br />address is P. O. Box 1885, Kearney, Nebraska 68847; and Ball Real
<br />Estate Co. of Kearney., a Nebraska corporation, (hereinafter BENEFICIARY),
<br />whose mailing address is P. O. Box 1973, Kearney, Nebraska 6884.7.
<br />FOR VALUABLE CONSIDERATION TRUSTOR irrevocably transfers.,
<br />conveys and signs to TRUSTEE in trust WITH POWER OF SALE, for the
<br />benefit and security of BENEFICIAF.Y, under and subject to the terms
<br />and conditions of this Deed of Trust and Security Agreement, the
<br />real property located in the City of Grand Island, Hall County,
<br />Nebraska, and described as:
<br />Lots 1 through 5, inclusive, Reed's Subdivision to the
<br />City of Grand Island, Hall County, Nebraska TOGETHER
<br />WITH alI of the rights and privileges granted under one
<br />certain License and Easement Agreement recorded in the
<br />office of the Register of Deeds for Hall County, Nebraska,
<br />on April 13, 1972, in Book 23, Miscellaneous Records,
<br />at Page 29:
<br />AND
<br />Blocks 1 and 2, Bellwood Subdivision, City of Grand
<br />Island, Hall County, Nebraska, TOGETHER WITH a permanent
<br />and perpetual easement and right-of-way to operate,
<br />construct, maintain, extend, repair, remove and replace
<br />a sanitary sewer line, manholes, surface markers and
<br />other appurtenances upon, over, in and through a tract
<br />of land more particularly described as follows: The
<br />North 16 feet of the West 130 feet of Lot 1 and the
<br />North 8 feet of the East 143 feet of the West 273 feet
<br />of Lot 1 all in Bureh Subdivision to the City of Grand
<br />Island, Hall County, Nebraska, together with the rights
<br />of unrestricted ingress and egress under, through and
<br />across the easement area herein defined for the purpose
<br />of exercising the rights herein granted, including the
<br />right to clear and keep clear of trees, roots, brush
<br />and other obstructions from the surface of such easement
<br />area;
<br />and also grants to TRUSTEE in trust a Security Interest in all of
<br />the personal property located upon the said real estate including
<br />furniture, appliances, equipment and machinery, which real estate
<br />and personal property is hereinafter described as PROPERTY.
<br />TOGETHER WITH all rents, easements, appurtenances, hereditaments,
<br />interests in adjoining roads, streets and alleys, improvements and
<br />buildings of any kind situated thereon and all personal property that
