<br />V3857-L - 9/15/BO <br /> <br />rity interest except as created or permitted hereunder or <br />under the Superior Mortgages. Mortgagee may enter upon and <br />inspect-the Property at any reasonable time during the life <br />of, this Mortgage. <br />5. Taking <br />In the event of any taking of all or any part of <br />the Property, either temporarily or permanently, as a result <br />of or in lieu of condemnation or eminent domain, Mortgagor <br />shall give Mortgagee prompt notice thereof, and shall commence <br />and comglete the restoration of the Property to a condition as <br />near as possible to its condition and ~itility prior to such <br />Taking. Mortgagee is hereby authorized to commence, agpear in <br />and prosecute, in its own name or Mortgagor's name, any action <br />or proceeding relating to any taking and to settle or compromise <br />any claim in connection therewith. All compensation awards, <br />damages, claims, rights of action and proceeds, and nay other <br />payments or relief and the right thereto, are hereby assigned <br />by Mortgagor to Mortgagee, and Mortgagee is empowered to <br />collect and receive the same and to give proper receipts there- <br />for in the name of Mortgagor and the same shall be paid forth- <br />kith to Mortgagee, Any award or payment so rtceived by Mort- <br />gagee shall, subject to the applicable provisions of the Super- <br />ior Mortgages, be applied to the restoration and repair of the <br />Property, with any remaining balance to be paid to Mortgagee <br />in reduction of the principal balance hereof. <br />fi.
