80-U O 5 ~ 89 <br />default under the Mortgage the whole of the Principal <br />5 um evidenced by this Note and secured by the Mortgage, <br />together with accrued and unpaid interest thereon, shall, <br />at the option of cM, become immediately due and payable, <br />without notice or demand. Failure of CM to exercise <br />such option ahall not constitute a waiver of the right to <br />exercise the same upon the occurrence of any subsequent <br />default. <br />CM, by accepting this Nate and the Mortgage, for <br />itself, its representatives, successors and assigns, in con- <br />sideration of the mutual covenants herein and therein con- <br />tained, does hereby covenant and agree that at no time will <br />any action, suit or proceeding be braught against Grand, <br />or any of the partners of Grand oz its or their representa- <br />tives, successors oz assia_ns, personally to recavez a money <br />judgment for repaymen*_ of the indebtedness evidenced <br />hereby or any pares thereof except far an action to fore- <br />close the Mortgage, and CM, for itself, its representatives, <br />successors and assigns, further covenants and agrees that <br />it will neither seek nor obtain a judgment for a deficiency <br />in any such foreclosure proceeding or in any action brought <br />or maintained subsequent to such foreclosure action for the <br />balance of the indebtedness hereunder remaining unpaid <br />after tha exhaustion of the seeurityF gzovided, however, <br />that nothing contained in this Note or the Mortgage shall <br />(a) be oz be construed as being a release or impairment of <br />the indebtedness secured by the lien of the Mortgage, or (b)oze- <br />clude CM from foreclosing the Mortgage in case of the occur- <br />zen:e of a default under the Mortgage or from enforcing any <br />3 <br />t_.._ <br />
