80-U O 5 ~ 89 default under the Mortgage the whole of the Principal 5 um evidenced by this Note and secured by the Mortgage, together with accrued and unpaid interest thereon, shall, at the option of cM, become immediately due and payable, without notice or demand. Failure of CM to exercise such option ahall not constitute a waiver of the right to exercise the same upon the occurrence of any subsequent default. CM, by accepting this Nate and the Mortgage, for itself, its representatives, successors and assigns, in con- sideration of the mutual covenants herein and therein con- tained, does hereby covenant and agree that at no time will any action, suit or proceeding be braught against Grand, or any of the partners of Grand oz its or their representa- tives, successors oz assia_ns, personally to recavez a money judgment for repaymen*_ of the indebtedness evidenced hereby or any pares thereof except far an action to fore- close the Mortgage, and CM, for itself, its representatives, successors and assigns, further covenants and agrees that it will neither seek nor obtain a judgment for a deficiency in any such foreclosure proceeding or in any action brought or maintained subsequent to such foreclosure action for the balance of the indebtedness hereunder remaining unpaid after tha exhaustion of the seeurityF gzovided, however, that nothing contained in this Note or the Mortgage shall (a) be oz be construed as being a release or impairment of the indebtedness secured by the lien of the Mortgage, or (b)oze- clude CM from foreclosing the Mortgage in case of the occur- zen:e of a default under the Mortgage or from enforcing any 3 t_.._
