Mortgagor hereby waives all rights of <br />marshalling of assets or liens in the event of any foreclosure <br />of the liens or security interest granted herein. <br />12.2 Upon the occurrence of an Event of Default, <br />Mortgagor, upon thirty (30) days' notice from Mortgagee, <br />shall forthwith surrender possession of the Property to Mort- <br />gagee and, to the extent permitted try law, Mortgagee (or such <br />officers or agents as it may appoint) may enter and takQ <br />possession of the Property, may exclude Mortgagor and its <br />agents and employees therefrom, and may have joint access with <br />Mortgagor to the books, papers and accounts of Mortgagor. Zf <br />Mortgagor shall for any reason fail to surrender or 3e liver <br />the Property or any part thereof after Mortgagee's notice, <br />Mortgagee may obtain at Mortgagor's cost, a judgment or decree <br />conferring on Mortgagee the right to immediate possession or <br />squiring Mortgagor to deliver mediate possession of all or <br />part of the Property to Mortgagee, and mortgagor here try speci- <br />fically consents to the entry of suds judgment or decree. <br />12.3 If Mortgagor shall default in the payment or <br />perforsiance of any of its o bligations under this Mortgage, <br />Mortgagee may, at its option, take such action (including, <br />without limitation, payment of any sums as to which Mortgagor <br />is so in default) as Mortgagee may deem appropriate to protect <br />i,ts interests hereunder, and any amount so expended by Mort- <br />ga4ee, vrith interest thereon as the highest rate then permit- <br />ted by tiffs laws of the State of Nebraska, shall ae payable by <br />Mortgagor to Mortgagee on demand and shall be secured by this <br />Mortgage, <br />16 <br /> <br />
