it <br />~; <br />#; ' V3~8!y57-L - 9/15/80 <br />17.2 Upon the occurrence of any Event of Default, <br />all of the indebtedness secured hereby shall, at Mortgagee's <br />option, become immediately due and paya ble without notice, <br />and Mortgagee may avail itself of alI rights and remedies <br />provided herein or at law, in equity or by statute. No delay <br />' or omission of Mortgagee to exercise any right, power or remedy <br />accruing upon any Event of Default shall exhaust or impair any <br />such right, paver or remedy or shall be construed to waive any <br />such Event of Default or to constitute acquiescence therein. <br />Every right, power and remedy given to Mortgagee may be exer- <br />cised fro~a time to time and as often as may be deemed expe- <br />dient by Mortgagee. <br />72. &emedies <br />72.1 Zf an Event of Default shall have occurred, in <br />addition to or concurrent with any other remedy provided herein <br />or to which Mortgagee may otheLVise ba entitled at law, in <br />equity or by statute, Mortgagee shall, either with or without <br />entry or taking possession, have the right and power at Mort- <br />gagor's expense, to fa} proceed by suit to specifically enforce <br />any covenant contained herein, (b) sell the Property or any <br />Bart thereof at pu blic or griva-Ce sale: subject to the laws of <br />the State of Nebraska to the contrary, free and clear of any <br />equity of redemption in Mortgagor, tc) o btain the appointment <br />of a receiver to collect the income, rents, issues and profits <br />free the Property and id) foreclose the lien hereof in any <br />appropriate proceeding.
