r {hereinafter the "Fund"} to the Shopping Center located in Grand Island, Nebraska, such said Shopping Center, hereinafter the "Grand Island Mall"; and WHEREAS, the parties hereto wish to amend and supplement the Fund,Agreement more specifically to set forth the intent and purpose of the parties for the establishment of the Fund for completion of common area improvements and for disbursement of the Loan proceeds., such sum not to exceed $706,000.00. NOW, THEREFORE, the parties hereto, in consideration of the premises and the Agreements hereinabove captioned and in further consideration of the sum of ONE DOLLAR ($1.00) each to the other in hand gold, receipt of which is hereby acknowledged, do hereby agree as follows: 1. Paragraphs 2, 3 and 4 of the Fund Agreement are hereby amended in their entirety as follows: Paragraph 2. Buyer estimates that total cost of certain proposed improvements to the common area of Grand Island Mall, hereinafter zrferred to as "Common Area Improvements" are approximately 538,000.00 which Common Area Improvements shall be constructed in accordance with the Pions and Sgecifications prepared by Buyer"s engineer or architect both of whom shall be licensed by the State of Nebraska, and who shall be designated the Project engineer or Project architect as the case may be, which Plans and Specifications have been approved by Seller. No changes shall be made therein witho;:t the prior written consent of the Seller which approval shall not be unreasonably withheld.
