r <br /> <br />{hereinafter the "Fund"} to the Shopping Center located in Grand <br />Island, Nebraska, such said Shopping Center, hereinafter the <br />"Grand Island Mall"; and <br />WHEREAS, the parties hereto wish to amend and supplement the <br />Fund,Agreement more specifically to set forth the intent and purpose <br />of the parties for the establishment of the Fund for completion of <br />common area improvements and for disbursement of the Loan proceeds., <br />such sum not to exceed $706,000.00. <br />NOW, THEREFORE, the parties hereto, in consideration of the <br />premises and the Agreements hereinabove captioned and in further <br />consideration of the sum of ONE DOLLAR ($1.00) each to the other <br />in hand gold, receipt of which is hereby acknowledged, do hereby <br />agree as follows: <br />1. Paragraphs 2, 3 and 4 of the Fund Agreement are hereby <br />amended in their entirety as follows: <br />Paragraph 2. Buyer estimates that total cost of certain <br />proposed improvements to the common area of Grand Island <br />Mall, hereinafter zrferred to as "Common Area Improvements" <br />are approximately 538,000.00 which Common Area Improvements <br />shall be constructed in accordance with the Pions and <br />Sgecifications prepared by Buyer"s engineer or architect <br />both of whom shall be licensed by the State of Nebraska, <br />and who shall be designated the Project engineer or Project <br />architect as the case may be, which Plans and Specifications <br />have been approved by Seller. No changes shall be made <br />therein witho;:t the prior written consent of the Seller <br />which approval shall not be unreasonably withheld. Simulta- <br />neously whit the execution hereof, Buyer shall deposit the <br />swa a€ $250,000.00 leas all sums gold to the Seller pursuant <br />to Paragraph t of the Fund Agreement, the account to be used <br />_Z_ <br />
