~- <br />~051~7 <br />$~'~' <br />AMENDMENT TO FQND AND LOAN AGREEMENT <br />AGREEMENT made this 15th day of September, 1.980 by and <br />between ASSET MANAGEMENT CORP., formerly known as Baited Jersey <br />Mortgage-Company, a New Jersey corporation with its principal <br />place of business at 25 East Salem Street, Ftackensack, New <br />Jersey, hereinafter referred to as "Seller", and GRAND ISLAND <br />MALL, LTD., a Nebraska limited partnership with an office at <br />2228 North Webb Road, Grand Island, Nebraska, hereinafter re- <br />ferred to as "Buyer". <br />W I T N E S S E T H: <br />WHEREAS, Seller entered into a certain Agreement dated as of <br />the 8th day of November, 1979 with Peter M. Cassidy for the sale <br />of certain lands in Grand Tsland, Nebraska, as amended by Amendment <br />to Agreement dated the 3rd day of December, 1974, and further <br />mended by Second Amendment to Agreement dated as of the 23rd day <br />of April, 1980, as further amended by Third Amendment to Agreement <br />dated as of the 24th day of August, 1980, hereinafter all collee- <br />Lively referred to as the "Agreements"; and <br />WHEREAS. Peter M. Cassidy did assign the Agreements to <br />CM Associates, a Nebraska general partnership and said CM <br />Associates did further assign the Agreements to Grand Island <br />Mall, Ltd., all by Assignment of even date herewith, both <br />Assignments being dated as of September i, 1980; and <br />WHSAEAS, said Agreements provided as an exhibit thereto a <br />Loan and Fund Agreement dated the 23rd day of April, i9$0 desig- <br />nated as "Exhibit C-1' to the Agreement which Loan and Fund <br />Agreement as hereby amended is hereinafter referred to as "Fund <br />Agraesxnt" provided for lending to the Buyer by the Seller a sum <br />not to exceed $700,000.00 to be used solely for tenant imprave- <br />ssnts.anc9 also provided for the establishment of a $ZSO,OO0,00 <br />fund bg the Buysr for the completion of oommon area improvements <br />
