~0-- i~04996 <br />partial prepayments, Grand shall also pay all accrued and <br />unpaid interest then due hereunder. <br />This Note is secured by a Subordinate Purchase <br />Money Mortgage (.the "Mortgage") on premises known as Grand <br />Island Mali, more particularly described in the Mortgage. <br />It is hereby agreed that upon the occurrence of a <br />default under the Mortgage the whole of the Principal <br />S um evidenced by this Note and secured by the Mortgage, <br />together with accrued and unpaid interest thereon, shall, <br />at the option of CM, become immediately due and payable, <br />without notice or demand. Failure of CM to exercise <br />such option shall not constitute a waiver of the right to <br />exerdise the same upon the occurrence of any subsequent <br />default. <br />CM, by accepting this Note and the Mortgage, for <br />a itself, its representatives, successors and assigns, in con- <br />sideration of the mutual. covenants herein and therein con- <br />tained, does hereby covenant and agree that at no time will <br />any action, suit or proceeding be brought against Grand, <br />or any of the partners of Grand or its or their representa- <br />tives, successors oz assigns, personally to recover a money <br />judgment for repayment of the indebtedness evidenced <br />hereby or any part thereof except for an action to fore- <br />close the Mortgage, and C_~!, for itself, its representatives, <br />successors and assigns, further covenants and agrees that <br />it will neither seek nor obtain a judgment for a deficiency <br />i.n any such foreclosure proceeding or in any action brought <br />3 <br /> <br /> <br /> <br />
