~< <br />80-u04847 . <br />• R E S O L U T I O N <br />A RESOLUTION OF THE CITY OF GRAND ISLAND, NEBRASKA, PROVIDING <br />' FOR THE MODIFICATION OF CERTAIN COVENANTS AND RIGHTS OF THE CITY <br />AS CONTAINED ZN A SPECIAL WARRANTY DEED WITH RESPECT TO LOTS <br />TWENTY-FIVE (25) AND TWENTY-SIX (26) IN BLOCK FIVE (5), PLEASANT <br />HILL ADDET ION TO THE CITY OF GRAND ISLAND, (FALL COUNTY, NEBRASKA, <br />AND AUTHORIZING THE IiXECUTION OF AN AGREEMENT WITH RESPECT THERETO. <br />BE ZT RESOLVED DY TF1E MAYOR AND COUNCIL OF THE CITY OF <br />GRAND ISLAND, AS FOLLOWS: <br />Section 1. The Mayor and Council hereby find and <br />' determine that by Special Warranty Deed, dated May 26, 1978, the <br />City has conveyed the following described property in Hall County, <br />Nebraska: <br />- Lots Twenty-five (25) and Twenty-six (26) in <br />Block Five (5), Pleasant Flill Addition to the <br />City of urand Island, Hall County, Nebraska <br />(herein referred to as the "Premises") <br />to Larry E. Huwaldt and that said Larry E. Huwaldt has in turn <br />convoyed said Premiaea to the Nebraska Association for Develop- <br />mental Housing, a Nebraska non profit corporation (herein referred <br />t0 as "Subsequent Grantee"); that said Subsequent Crantes has <br />presented tq the Community Development Agency of the City of Grand <br />Island its proposal for developing the Premiaea by eonatruction of <br />a swltiple family reaidentlal project thereon for purposes of <br />~ housing handicapped persons; that the City's Community Development <br />Agency has reviewed plane and epecificatigns for said improvements <br />and hoe given its approval thereto; that said Community Cevelopment <br />Agenry has as of July 16, 1980 consented [q the granting of a <br />torty-fire day extension (until September 15, 1990) for cha <br />r oo>wancing of the construction o! said project and a period of <br />nine months thereafter within which as id project is to be carried <br />to completion; that in connection with said Subsequent Grantee's <br />financing of said project by the United SLatee of America, acting <br />through the Secretnry of Housing and Urban Revelopment, said <br />Subaegwnt Grantee hoe advised th+ City that is i• necoaee cy tnnt <br />certain of the previsions of said Special Warrenfy Dead t» modiliad; <br />.~ that an agreew.:nt entitled "Modification Agreement" for ouch <br />purposes has been prepared and prasonted and the terms and condi- <br />t1oM o! said agrsea»nt be and they era hereby approved. <br />
