<br />84._004636 <br />EASEMENT <br />WHEREAS, Esther D. Beck and Wilbur R. Beck, wife and husband,. <br />as joint tenants and not as tenants in common, are the owners of <br />the North Half of the Northwest Quarter (N~NW~) of Section Five <br />(5), Township Eleven (11) North, Range Eleven (11) West of the <br />6th P.M. in Hall County, Nebraska, hereinafter referred to as <br />"Tract #1"; <br />WHEREAS, Alice S. Beck and Delbert G. Beck, wife and husband, <br />as joint tenants and not as tenants in common, are the owmers of <br />that property described as the South Half of the Northwest Quarter <br />(S'~NW~) of Section Five (5), Township Eleven (11) North, Range <br />Eleven (11) West of the 6th P.M., hereinafter referred to as "Tract <br />#Z" <br />WHEREAS, the only access to the portion of Tract #2 located <br />east of Prairie Creek is by making use of an existing road over and <br />upon Tract #1 along the easterly bank of Prairie Creek on 'T`ract #1 <br />which road has been used for many years last past to permit the <br />easterly portion of Tract #2 to be farmed; <br />WHEREAS, the owners of Tracts #1 and #2 desire to enter into <br />a written memorandum defining the easement rights of the owners <br />of Tract #2 over and upon the easterly part of Tract #1 for the <br />purposes of making use of the access road; <br />NOW TH~tEFORE BE IT KNOWN that in consideration of the sum of <br />One Dollar ($1.00) being paid by Alice S. Beck and llelbert G. Beck, <br />wife and husband, the receipt whereof' is hereby acknowledged, <br />Esther D. Beck and Wilbur R. Beck, wife and husband, hereby .end <br />by these presents, do grant and convey unto AL ice S. Beck and <br />Delbert G.
