<br />and liens or titles thereunder accrued or l::vied after this- <br />date, and subject to all liens or transfers made or suffered <br />to be made by the Buyer. <br />6. If Buyer shall fail for a period of sixt;r (b0) days <br />from due date to make any payment or perform any agreement <br />herein contained, or shall breach any of the covenan~s herein <br />contained, Seller may at any time after such breach or failure, <br />at her election, declare the full amount remaining unpaid on <br />said purchase price together with unpaid interest, taxes, <br />insurance premiums, to be immediately due and payable. The <br />Seller may further, at her option, at any time after such <br />failure, consider and treat t'.~is contract as null and void, <br />and may retain whatever sum has been paid by the Buyer as <br />her tenant, holding over without permission after the expiration <br />of said sixty (60) day term, and may take immediate possession <br />of said premises, and remove the Buyer or any person holding <br />under bim therefrom, and may sell and convey the said lands <br />and deliver possession thereof to any other person ca.ithoui <br />liability to the Buyer therefore. <br />7. It is agreed that time is of the essence of this <br />contract and it shall be so construed by all Courts, and no <br />waiver of time or manner of performance shall be implied <br />or alleged to excuse a failure in performance thereof unless <br />such waiver be in writing, signed by the person against whom <br />it is implied or alleged, and that any judgment in favor o£ <br />Seller and against the Buyer for the said purchase price, <br />unpaid interest, taxes and insurance premiums, or env part <br />thereof, shall not be construed as a performance by the Buyer <br />until such judgment has been fully paid and satisfied. <br />S. It is mutually agreed that the personal character <br />and responsibility of the Buyer is a part of the consideration <br />of this contract and the Buyer agrees that he c•~i11 not assign <br />this contract or any interest therein to any person or persons, <br />and that he will not let or suffer any other person to enter <br />into possession of said premises or any part thereof orithout <br />
