80-~~ <br />- 3 - <br />D. No power or mechanica}ly driven boats using a motor exceeding five <br />...... (5) horse power shall be placed in or used on said "Brentwood Lake" <br />by any take front owner ar their guests. <br />E. Any real estate taxes }evied and assessed against "Brentwood Lake" <br />shall be borne equally and paid by owners of platted lots adjoining <br />and abutting "Brentwood Lake". Said taxes shall be prorated by number <br />of lots only, regardless of any actual difference in size of lots. <br />Any owner who fails to pay his or her respective pro-rated share of <br />real estate taxes on said lake when the same become due antl legally <br />payable shall have no further rights to use said lake until such time <br />as said pro-rata share of taxes are paid by said }ot owner. <br />F. AlT owners of lots adjoining or abutting said "Brentwood.Lake" acknow- <br />ledge that no other owner of any other lot or lots in Brentwood Sub- <br />division, Brentwood Second Subdivision and Brentwood Third Subdivision, <br />has any express or implied duty to maintain Brentwood Lake, to super- <br />vise the use of said lake, or to take any steps or measures to protect <br />any others in their use of said lake. <br />G. No minnows or any type of bait fish shall be used for fishing in <br />Brentwood Lake. <br />16. As soon as ninety (90) percent of the lots in Brentwood Subdivision, Brent- <br />wood Second Subdivision and Brentwood Third Subdivision fronting on "Brentwood Lake" <br />are sold to owners other than Brentwood Development Company of Grand Island, the fol- <br />lowing provisions shall apoly: <br />A. A corporation named Brentwood Lake, Inc. shall be incorporated <br />which corporation will own that portion of Brentwood Lake to <br />be deeded to said corporation by Brentwood Development Company <br />of Grand Island. <br />B. One share of stock, representing one vote, will be issued to the <br />owner or owners of each }ot adjacent to and fronting on said lake, <br />said stock to run ari th the land and automatically transfer to any <br />new owner upon the sale of any tot adjacent to and fronting on <br />said land. <br />A Board of Directors consisting of five (5) stockholders shall he <br />elected annually and said Board of Directors shall control by maj- <br />ority vote of the same, the management and operation of said "Brent- <br />wood Lake", which shall include, but not be limited to the assess- <br />ment of up to STOO per lot per year for maintenance of appearance <br />of said Take and shoreline, water quality control and any and all <br />other matters pertaining to said lake. Any lots adjacent to and <br />fronting on said lake that have a multi-family dwelling shall be <br />assessed•on the basis of originally platted lots and said original- <br />ly platted lots shall be assessed by the lot and not by the number <br />of dwellings located on said Tots. <br />D. The failure of any lot owner fronting on said lake to pay any assess- <br />ments as set forth above, within 30 days of being notified of said <br />assessment, shall result in said lot owner having no further privi- <br />leges in regard to the use of said "Brentwood Lake" until said de- <br />linquent assessments are paid in full. <br />E. The owners of lake front lots agree to keep the shoreline abutting <br />the lot owned by said lot owner in a good state of repair and said <br />aafners agree that no floating docks or unsightly docks will be con- <br />structed or used by any such lake front lot owners. tlo docks shall <br />extend beyond five (5) feet into the lake nor shall any boat storage <br />garage be built on said }akeshore. <br />17. If any owner of any lot, ar their heirs or assigns shall violate or attempt to <br />violate any of the covenants, restrictions and conditions herein set forth, it shall be <br />lawful for any other person or persons owning any real estate in said addition to pro- <br />secute such proceedings at law or in equity against the person or persons violating or <br />attempting to violate any such covenants and to prevent him from so doing or to recover <br />damages for such violations. <br />16. If any of the covenants, restrictions or conditions herein set forth are de- <br />clared void 'vy a court of competent jurisdiction, the remaining covenants, restrictions <br />ar conditions shalt pat be aff'e:.ted, but shall main in full force and effect. <br />
