<br />The First Parties agree that they wi11 bring the Abstract of Title to`
<br />dste on or before the 1st of July and will deliver the Abstract of Title tki--seii3
<br />Second Par`~y showing a marketable Legal title to be vested in said First Parities,
<br />free and clear from all liens and encumbrances whatsoever except as may be placed
<br />or suffered to be placed thereon by the Second Party and they are accepting tkiis
<br />property subject to any easements, reetrictions9 or covenants of recissd
<br />Any easements, restrictions or covenants of record shall not be':
<br />construed as a breach of the warranty ar in violation of the contract or affect
<br />the marketability of title.
<br />The Second Party shall have his attorney examine the abstract of tit]:e
<br />imwediately. The First Parties shall have a reasonable time thereafter to-correct:.:, -
<br />any defects, after which the abstract shall be recertified if any additional
<br />entries make it necessary and be placed with the escrow agent, IF defects cannot-
<br />be corrected, then this eontratt shall, be void without penalty and all parties-
<br />shal3 be placed in the same position they were in before this agreement was
<br />entered intn as near as possible,
<br />3t is ag-reed that three copies of an attwrtized sheet shall be ooteined
<br />at the equal expense of bath parties and each Party shall have a copy with the
<br />4tinkler Realty Co„ the escrow agent, also having one and as the payments are made
<br />^t t.=e n Haler Realty Ca., they shall be endorsed upon the copy of +,J:e at:eartized,
<br />sheet. The escrow fees of X10,00 per month for serving as escrow agent shall be
<br />split evenly by both parties on an even basis.
<br />In event of the failure to pay any instai7;ment promptly when due, or
<br />within 30 days thereafter, time being of the essence, r rst Parties may elect to
<br />declare the entire principal and interest remaining unpaid as due and payable
<br />forthwith, and in event of failure to pay the same shall be entitled to for$clase
<br />this contract for the total principal amount with interest. Any installments
<br />delinquent shall draw interest aG the rate of 1396 per annum if not paid promptly
<br />when due. Zn event of a breach of the conditions of this contract, the First Parties
<br />may elect to declare the entire amount due and owing, in which event it shall draw
<br />interest at i3$ from the date until paid, and the First Parties shall be entitled
<br />W foreclose this contract for the amount as found clue with interest and costs,
