Corporation, a not for profit corporation existing under the- Nebraska Non Profit Corporation Act (the "Sublessor"), and jointly.; and severally, the Unnamed Interlocal Cooperation Act Agency _ established by the counties comprising Region 3 as describes in Section 83-1,1A3.46 R.R.S. Neb. 1993, pursuant to an agreement executed ir, 1971, as amended a n d currently in effect, and Mid- Nebraska Mental Retardation Services, Inc., a Nebraska non profit corporation (referred to herein jointly and severally as a "Sub- lessee"). WZTNESSETH: WHEREAS, Sublessor and Sublessee have entered into a Sublease, dated as of the first day of July, 19?9, which appears of record in the office of the Register of Deeds of Hall County, Nebraska, as Document No. 79-005190 ithe "Sublease") and pur- suant thereto Sublessee has sublet from Sublessor a facility suitable for the treatment, including training and rehabilitation, of mentall}> ill, retarded and disabled persons (*.he "Project") located on and including the premises described in Exhibit "A" as attached hereto and by such reference made a part hereof, in Hall County, Nebraska. WHEREAS, under the terms of Section A.2 of the Sublease, Sublessee has agreed that if the 1979 Construction rund, as described and referred to therein, shall be insufficient to fully pay all the casts of constructing and acquiring the Project, Sublessee shall pay in cash the full amount of any such deficiency provided that Sublessee's obligation to make such pay:aent may be reduced to the extent that Completion Eicnds are issued pursuant to that Sond Resolution adopted July 24, 1979 by Hospital Authority Na. 1 of Hall County, Nebraska (the "Authority"). WHSRBAS, Sublessor in order to enable the Authority to issue Completion Sonde is required to increase the amount of rentals payable by Sublessor pursuant to that. :.ease F~greement by and between
