WOLFE, as husband and wife, ands} <br />in their own right, as Trustor, whose address is 31211 West'"L' <br />Brentwood Circle, Grand Island, Nebraska 68801; JOHN R. <br />BROWNELL, 231 South Locust, Grand Island, Nebraska 68801, as <br />Trustee; and COMMERCIAL SAVINGS COMPANY OF GRAND ISLAND, <br />whose address is 2121 North Webb Road, Box 97'1, Grand Island, <br />Nebraska, as Beneficiary. <br />WITNESSETH: <br />That Trustor conveys, sells, and warrants to Trustee in <br />trust, with power of sale, the following described real pro- <br />perty: <br />Lot One (1), Wolfe's Subdivision, in the <br />City of Grand Island, Hall County, Nebraska. <br />The intention being to convey hereby an absolute title in fee <br />simple, together with all buildings, fixtures, improvements, <br />and appurtenances thereto belonging. <br />The Trustor covenants and agrees with the said Trustee <br />and Beneficiary that he is lawfully seized of said premises; <br />that he has good, right and lawful authority to sell and con- <br />vey said premises; that said premises are free and clear of <br />all liens and encumbrances; and that Trustor will warrant and <br />defend the title to said premises unto the Trustee and his <br />successors and assigns forever against the claims of all <br />persons, <br />FOR THE PURPOSE OF SECURING performance on eaeh agreement <br />of Trustor herein contained and the payment of Fifty Four <br />Thousand Seven Hundred Thirty One and 51j100 Dollars ($54,731.51), <br />as evidenced by a promissory note bearing even date at the rate <br />of twenty percent (208) per annum until paid; the principal <br />sum and interest shall be payable on October 23, 1980. All <br />payments shall be made at the office of the Beneficiary, <br />Commercial Savings Company of Grand Island, or at such other <br />place as the holder may designate in writing. <br />It is agreed by and between the parties hereto that while <br />title is vested in the Trustee and until filing of Notice of <br />Default, the Trustor shall: <br />A. Retain possession of the premises and collect the <br />rents and revenues therefrom. <br />B. Maintain the buildings and improvements located <br />thereon in good condition and repair. <br />C. Pay all taxes and special assessments levied or <br />assessed against or due upon said premises before <br />delinquency, and to deliver to Beneficiary copies <br />of receipts showing payment of such taxes. <br />
