r <br />~u.. +xac~e~ <br />3. Sanitary Sewer. The Subdividers agree to petition for <br />the construction of a sanitary sewer main is Che easements an the <br />east side of the lots of the subdivision to serve all lots in the <br />subdivision prior to requesting any occupancy permit for any structure <br />in said subdivision, and agree to connect such structures to the <br />City's sanitary sewer. In the alternative, the Subdividers may <br />construct a sanitary sewer in accordance wfth pions and specifications <br />approved by the City's director of public works and subject to the <br />City's insgectivn. <br />4. Drainage. The Subdividers agree to grade the Lots of the <br />subdivision in conjunction with the structures thereon so that the <br />storm water drains to the public right-of-way and to the City storm <br />drainage system. <br />5. Sidewalks. The Subdividers, if still the owners of the <br />land in the proposed subdivision, or if the Subdividers shall have <br />transferred title to the property, then the various grantees thereof, <br />will install, at their own expense, all public sidewalks required by <br />the Grand Island City Code when the adjacent lot is built upon, and <br />sidewalks shall be regulated and required with the building permit <br />for each such Iot. <br />b. '~iarrattty. The undersigned owners, as Subdividers, warrant <br />t:tat they are the owners in fee simple of the land described and <br />proposed to be known as Theasmeyer-Neubert Subdivision, and that an <br />abstracC of title will be submitted for examination, if necessary, <br />upon request of the City of Grand Island. <br />7. This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the parties hereto, their successors, <br />assigns, heirs, devisees, and legatees.
