TfiEASPEYER, husband and wife; and MICHAEL L. ttEUBERT and BRENDA 3. I~UBERT, husband and wife, hereinafter called the Subdividers, as own®rs of. a tract of land comprising all of Lot Eight (8), Block One (1), Colonial Estates Second Subdivision, City of Grand Island, Nebraska, said tract containing f?.568 acres, more or less, desire to have subdivided as a subdivision the above described tract of land which is located within the corporate limits of the City of Grand Island, ;tebraska, and hereby sulamit to the City Council of such City for acceptance as provided by Iaw an accurate map and plat of such proposed subdivision, to be known as THEASMEYER-NEIIBERT St3BDZYiSION, designating explicitly the land to he laid out and particularly describing the lots and easements belonging to such subdivision, with lots designated by numbers and easements by dimensions, and propose to cause r.he plat of such subdivision when finally approved by the cZegional Planning Commission and the Citv Council to be acknowledged by such owners, certified as to accuracy of survey by a registered land surveyor, and to contain a dedication of the easement to the use of public utilities, In consideration of the acceptance of the plat of said Theasmeyer-Neubert Subdivision, the Subdividers hereby consent and agree with the City of Grand Island, Nebraska, thaC they will install ox provide at their expense the following improvements: 1. Paving. The Subdividers waive the right to abject to any repaving district on Faidley Court or Faidley avenue where they abut said subdivision. Z. '.Dater. There is presently an existing water ^sain in Faidley Court, known as Projeer_ 78-w-4, The Subdividers agree to connect all structures in the subdivision to said City watermain prior to applying for occupancy permits for any st;ch structures. ~;t
