said Double R Subdivision, the Subdivider hereby consents and agrees with the City of Grand Island, Nebraska, that it w£11 install or provide at their expense the fallowing i.mpravements: 1. Water and Sanitary Sewer. No municipal water or sanitary sewer service is available to said subdivision. The City therebp authorizes the construction of individual septic tanks and wells is accordance with existing regulations of the Department of Public Health. The Subdivider furthermore waives its right to protest the creation of any water or sanitary sewer districts within said subdivision and to connect the individual structures located in said subdivision to said water and. sanitary sewer mains within three construction seasons after completion of the. construction of said mains. 2. Storm Drainage. The Subdivider agree to grade all Iots within said subdivision so that storm water drains toward public right-of-way. The Subdivider further agrees to provide any area of sufficient capacity to contain storm water flow equivalent to a ten-year storm. Such plan for storm water detention shall be approved by the City's Director of Public Works prior to the issuance of an occupancy permit for any structure within said subdivision. 3. Paving. The Subdivider agrees to pave all streets within said subdivision in accordance with current subdivision regulations and plans and specifications approved by the City's Director of Public Works and the County's Director of Public Works. The Subdivider further agrees to waive its right to protest any repaving district within said subdivision or to a paving or repaving district of 13th Street where it abuts said subdivis iron . 4. Sidewalks- The Subdivider, if still the owner of the land in the proposed subdivision, or if the Subdivider shall have transferred title to the property, then the various grantees thereof, will install, at their own expense, all public sidewalks ~~ requited by subsection S of Section 32-12 of the t=rend Island City G9d8 when each lot i.s built upon, and sidewalks shall, he regulated and required with rite building permit kor each such lot.
