<br />2. Water. Public water service is available to all lots <br />within said subdivision, with the following conditions: Water <br />service for Lot 2 shall be supplied through an eight-foot water <br />easement as indicated in the plat of the subdivision. Said water <br />service shall be installed and remain the property of the ownex <br />of Lot 2 of said subdivision. The owner of said Low shall be <br />required to maintain and keep said private water service in good <br />working condition. <br />3. Sanitary Sewer. Sanitary sewer service is available to <br />all lots within said subdivision. Lat 1 is currently served by <br />sanitary sewer through an easement in Lot 2 as shown on said <br />subdivision plat. The Subdivider agrees that the owner of Lot l <br />shall retain full responsibility for the operation and maintenance <br />of said sanitary sewer service across Lot 2. <br />4. Storm Drainage. Storm water falling upon said suh- <br />. division currently drains to public right-of-way and may continue <br />to do so <br />5. Sidewalks. The Subdivider, if still the owner of the <br />land in the proposed subdivision, or if the Subdivider shah have <br />transferred title to the property, then the various grantees <br />tti2reaf, will install, at .their awn expense, all public sidew#1,ka <br />required-by the. Grand. Island._Cty Code when..the.adjacent.. fiat i$ <br />built upon, and wisewalks shall be regulated and required with the <br />building permit for each such lot. <br />6. Warranty. The undersigned owner, as Subdivider, warrants <br />that she is the owner in fee simple of the land described and <br />proposed to be known as Freeman Subdivision, and that an abstract <br />of title will be submitted for examination, if necessary, upon <br />request of the City of Grand Island. <br />7. This agreement shall run with the land and shall be <br />blinding upon and inure to the benefit of. the parties hereto, <br />their successors, assigns, heirs, devisees, and legatees. <br />2 - <br />
