In consideration of the acceptance of the plat of said Eagle Subdivision, the Subdividers hereby consent and agree with the City of Grand Island, Nebraska, that they will install or provide at their expense the follow- ing improvements: 1. Paving. The Subdividers agree to pave Linden Avenue and Stoneridge Path ir. accordance witY. plans and specificaticns•approved by the Eiall County Director of Public Works. Furthermore, the Subdividers agree to waive the right to protest any paving or repaving districts on Bismark Road, Linden Avenue, and Stoneridge Path where they abut said subdivision. 2_ Waver and Sewer. City water ~^d sewer service is not available to the subdivision. Accordingly, the use of private wells and septic tanks is hereby authorized. The Subdividers waive 'their right to pro- test the creation of any water or sanitary sewer district within said subdivision, and to connect any and all new structures within said sub- division to said public water and sewer mains within one year after availability. 3. Drainage. The Subdividers agree to grade all Lots in the sub- division in conjunction with the construction of any structures thereon so that=~a~`m water drains to public right-of-way. 4. Sidewalks. The Subdividers, if still the owners of the land in the proposed su3xlivision, or if the Subdividers shall have transferred title to the property, then the various grantees thereof, will install, at their own expense, all public sidewalks as required by the Grand Island City Code, in particular subsection B of Section 32-22 thereof, when each let is built upon, and sidewalks shall ba regulated and required with the building permit for each such lot; provided, lots with existing structures need not install sidewalks until so ordered by the City Council. 5.
