<br />surveyor, and to contain a dedication of streets to t_ie use of the <br />public forever, and of easements to the use of public utilities. In <br />consideration of the acceptance of the plat of said Eagle Subdivision, <br />the Subdividers hereby consent and agree with the City of Grand Island, <br />Nebraska, that they will install or provide at their expense the follow- <br />ing improvements: <br />1. Paving. The Subdividers agree to pave Linden Avenue and <br />Stoneridge Path ir. accordance witY. plans and specificaticns•approved by <br />the Eiall County Director of Public Works. Furthermore, the Subdividers agree <br />to waive the right to protest any paving or repaving districts on Bismark <br />Road, Linden Avenue, and Stoneridge Path where they abut said subdivision. <br />2_ Waver and Sewer. City water ~^d sewer service is not available <br />to the subdivision. Accordingly, the use of private wells and septic <br />tanks is hereby authorized. The Subdividers waive 'their right to pro- <br />test the creation of any water or sanitary sewer district within said <br />subdivision, and to connect any and all new structures within said sub- <br />division to said public water and sewer mains within one year after <br />availability. <br />3. Drainage. The Subdividers agree to grade all Lots in the sub- <br />division in conjunction with the construction of any structures thereon <br />so that=~a~`m water drains to public right-of-way. <br />4. Sidewalks. The Subdividers, if still the owners of the land <br />in the proposed su3xlivision, or if the Subdividers shall have transferred <br />title to the property, then the various grantees thereof, will install, <br />at their own expense, all public sidewalks as required by the Grand <br />Island City Code, in particular subsection B of Section 32-22 thereof, <br />when each let is built upon, and sidewalks shall ba regulated and required <br />with the building permit for each such lot; provided, lots with existing <br />structures need not install sidewalks until so ordered by the City Council. <br />5. Warranty. fine undersigned Subdividers and Owner, warrant that <br />they are the owners in fee simple of the land described and proposed. to <br />be known as Eagle Subdivision, and that an abstract of title will be <br />submitted for exaniaati,ri, if necessary, upon request of the City of <br />Grand Island. <br />- 2 - <br />
