79-~ O{65'78 AFFIDAVIT - HELEN M. SIMMONS STATE OF NEBRASKA ) } ss. CO-LINTY OF HALL } Helen M. Simmons, being first duly sworn on her oath, deposes and states as follows: that she is a resident of brand Island, Hail County, Nebraska, and is one of the mortgagees in a real estate mortgage on the rea] property described en Exhibit "A" attached hereto which mortgage is recorded in Book 164 of real estate mortgages at Page 308 thereof of the records on file in the Office of the Register of Deeds, Hall County, Nebraska; that her sister, Florence Winifred Harrison, also known as Florence W. Harrison, was the owner of an undivided one-third interest in said mortgage and that said Florence Winifred Harrison died on June 14, 1974, a resident of the State of Colorado at the time of her death; that the undivided one-third interest in said real estate mortgage belonging to said Florence Winifred Harrison passed and descended or. her death to her six children, her heirs-at-law, as follows: Howard Simmons Harrison (a7 so known as Howard Harrison} Wayne Clarence Harrison (also known as Wayne C. Harrison}, Claude Edward Harrison, Calvin Stanley Harrison {also known as Clavin S. Harrison}, Ella Ruth Harrison (also known as Ella R. Harrison} and Allen Evan Harrison (also known as Allen E. Harrison}, who are also the sole and only beneficiaries under the Last Will and Testament of said Florence Winifred Harrison; that subsequent to the death of said Florence Winifred Harrison, one of her heirs, the said Claude Edward Harrison died intestate on or about March 14, 1979, a resident of the State of Colorado; that under the laws of the State of Colorado the undivided one-eighteenth interest in the aforesaid mortgage owned by said Claude Edward Harrison, descended in equal one-fifty shares to his hrothers and sister, then surviving, to-wit: Howard Simmons Harrison, Wayne Clarence Harrison, Calvin Stanley Harrison, Ella Ruth Harrison and Allen Evan Harrison; that attached to this affidavit and made a part hereof is the duly executed affidavit for collection of personal property pursuant to small estate proceedings under the laws of the State of Colorado, duly executed by the heirs-at-law of said Claude Edward Harrison; that affiant knows of her own personal knowledge that said heirs are tfie identical persons Who executed the release of Mortgage recorded on July 17, 1979 as Document ~7~-1??4>rtr3 in the Office of the Register of Deeds of Hall County, Nebraska.
