<br />79- ~5~~2 <br />2. Water. The Subdividers agree to construct necessary water <br />mains to serve all lots within said subdivision in accordance with <br />plans and specifications approved by the City's Director of Public kTOrks <br />and subject to the City's inspection. In the alternative, the Subdividers <br />may petition for the creation of a water district, to serve all lots <br />within said subdivision. The Subdividers agree to connect all structures <br />within said subdivision to said water main prior to the issuance of any <br />occupancy permits. <br />3. Sanitary Sewer. Sanitary sewer service is currently available <br />to all lots within said subdivision. The Subdividers agree to connect. <br />all structures within said subdivision to said sanitary sewer service <br />prior to the issuance of any occupancy permits. The Subdividers further <br />agree to pay ary and all connection charges to said sanitary sewer ser- <br />vices prior to the issuance of a building permit. Said connection charges <br />shall be determined for each lot by the Public *.dorks Department for the. <br />City of Grand Island. <br />4. Storm Drainage. The Subdividers agree to grade all lots in <br />accordance with the structures located thereon so that storm water drains <br />to public right-of-way. The Subdividers further agree to grade Lot;Y L <br />and 10 of said subdivision, together with adjacent public right-of-way, <br />in such a manner as to create a temporary storu~ water detentian are_ <br />of sufficient size to store runoff from a ten-year rain for said sub- <br />division. <br />5. Sidewalks. The Subdividers, if still the owners of the Land in <br />the progosed subdivision, or if the Subdividers shall have transferred <br />title to the property, then the various grantees thereat, will install, <br />at their own expense, ail public sidewalks required by the Grand Island <br />City Code when the adjacent lot is built upon, and sidewalks shall be <br />regulated and required with the building permit for each such Iot, <br />6. Warranty. The undersigned owners, as Subdividers, warrant that <br />they are the owners in fee simple of the land described and praposed to <br />be-known as Fark Gardens Subdivision, and that an abstract of title will <br />be submitted for examination, if necessary, upon request of the City of <br />-Grand Island. <br />7. This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the garties hereto, their successors, <br />
