<br />79-~',)~~~2 <br />SUBDIVISION AGREEMENT <br />PARK GARDENS SUBDIVISION <br />In the City of Grand Island, Nebraska <br />The undersigned, ELMER J. HALL and RUTH J. HALL, husband and wife, <br />hereinafter called the Subdividers, as owners of a tract of land compris- <br />ing the westerly four hundred twenty-two and two-tenths (422.2) feet <br />of the southerly five hundred thirty-eight (538) feet of the Southwest <br />Quarter of the Southwest Quarter (SW~SW4) of Section Twenty-one (21), <br />Township Eleven (11) North, Range Nine (9) West of. the bth P. M., in the <br />City of Grand Island, Hall County, Nebraska, said tract containing 5.214 <br />acres, more or Tess; desire to have subdivided as a subdivision the above <br />described tract of land which is located within the corporate limits of <br />the City of Grand Island, Nebraska, and hereby submit to the City Gouncil <br />of such City for acceptance as provided by law an accurate map and plat <br />of such proposed subdivision to be known as Park Gardens Subdivision, <br />designating explicitly the land to be laid out and gar*_icularly describing <br />the lots, streets, and easements belonging to such subdivision, with Iots <br />designated by numbers, streets by names, and easements by dimensiaris, and <br />propose to cause the plat of such subdivision when finally approved by <br />the Regional Planning Commission and the City Council to be acknowledged <br />by such owners, certified as to accuracy of survey by ~; registered l:~nd <br />surveyor, and to contain a dedication of streets to the use and benefit <br />of the public forever, and of easements to the use of public utilities. <br />In consideration of the acceptance of the plat of said Park Gardens Sub- <br />division, the Subdividers hereby consent and agree with the City of <br />Grand Island, Nebraska, that they will install or provide tit ~-heir <br />expense the following improvements: <br />1. Paving. The Subdividers agree to petition for the creation <br />of a paving district to pave Stolley Park Circle prior to the issuance <br />of any building permits for said subdivision. In the alternative, the <br />Subdividers may install in accordance with plans and specifications <br />approved by the City's Director of Public Works and subject to the City's <br />inspection paving for Stolley Park Circle. The Subdividers further <br />agree to waive the right to protest to the creation of any repaving <br />district for Stolley Fark Road where it abuts said subdivision. <br />....F~~. <br />
