<br />section 16.3 i~'henever the consent or approval of either <br />the Sublessor or Sublessee is required to be given to some action <br />or request of the other, neither shall unreasonably, arbitrarily or <br />unnecessarily withhold or refuse to give such approval or consent. <br />Section 16.4 The pasties acknowledge that the Authority <br />may have expenses in connection with the Project and in performing <br />t its functions under the Lease. The Sublessee agrees that such <br />expenses of Authority shall be reimbursed to the Authority by <br />Sublessee or paid directly by Sublessee; provided, however, that <br />the total amount reimbursed or paid in any one year shall not exce~~ <br />$1,000 unless the parties shall otherwise agree. <br />Section 16.5 So long as any of the Bonds are outstanding, <br />this Sublease may ha amandaA~ nhangcrj or mpe9i ficyi only ag rr}rnyiraeA <br />specifically herein or in the Lease. <br />Section 16.6 This Sublease shall be construed and enforced <br />in accordance with the laws of the State of Nebraska. Wherever in <br />this Sublease it is provided that either party shall or will make any <br />payment or perform or refrain from performing any act or obligation, <br />each such provision shall, even though not expressed, be construed as <br />an express covenant to make such payments or to perfozm or not to <br />perform, as the case may be, such act or obligation. <br />Section 75.7 if for any reason any provision hereof shall <br />be determiners to be invalid tar unenforceable, such invalidity or <br />unenforceability shall not affect the other provisions hereof. <br />Section 16.8 The covenants, agreements and conditions <br />herein contained shall be binding upon and inure to the benefit of <br />the parties hereto and their respective successors and assigns. <br />Section 16.9 This Sublease may be executed simultaneously <br />in two or more counterparts, each of which shall be deemed to be <br />an original, but all of which together shall constitute one and the <br />same instrument, <br />33 <br />
