~~ ~~~i., <br />ARTICLE XVI <br />NOTICES, INTERPRETATION ANO <br />EXPENSES OF ADTHORITY <br />Section 16.1 All notices, demands and requests which <br />may or are required to be given by either party to the other shall <br />be in writing and all such notices, demands or requests shall be <br />deemed duly served and delivered for all purposes (a) upon the <br />Authority, if delivered in person, to its duly qualified and acting <br />Chairman or Secretary or if a copy thereof be mailed, by certified <br />or registered mail, postage prepaid, addressed to Hospital Authority <br />No. 1 of Halt County, Nebraska, in care of the County Clerk of Hall <br />County, Courthouse, Grand Island, Nebraska 68801, or to such other <br />address as Authority may from time to time designate in writing; <br />(b) upon Sublessor if delivered irx person, to any officeivr direc- <br />tor of Sublessor or if a copy thereof be mailed, by certified or <br />registered mail, postage pzepaid, addressed to C. Burnett Terman, <br />831 East Phoenix, Grand Island, Nebraska 68801, or to such other <br />address as Sublessor may from time to time designate in writing <br />Sublessee; and (c) upon Sublessee if a copy thereof be mailed, <br />by certified or registered mail, postage prepaid, addressed to <br />Nid-Nebraska i~entai Retardation Services, P. J. Box 114b, 522 East <br />Side Boulevard, Has*_ings, Nebraska 68701, or such other address as <br />Sublessee may from time to time designate in writing. All notices <br />given by certified or registered mail as aforesaid shall be deemed <br />duly given as of the date they are so mailed. <br />Section 16.2 The Sublessor and Sublessee shall each be <br />entitled to specific performance and injunctive or other equitable <br />relief for any breach or threatened breach of any of the provisions <br />of this Sublease, notwithstanding the availability of an adequate <br />remedy at law, and each party hereby waives the right to raise such <br />defense in any groceeding in equity. The specific remedies provided <br />for in this Sublease are cumula*_ive and not exclusive of any other <br />remedy. The failure of either party to insist in any one or more <br />caeca upon strict performance shall not be construed as a waiver or <br />relinquishment for tb.e future. <br />32 <br />
