7~~..~,~5~.'J <br />to be gi°en to Sublessee had already 'been given and the geriod <br />for curing the default had expired. _ <br />Section 9.4 So long as any Bonds are outstanding, and <br />anything herein contained to the contrary notwithstanding, the <br />Trustee and the Au±hority, severally, shall have the right, in <br />their discretion at any time or from time to time, to perform and <br />discharge any of the duties and obligations of the Sublessor set <br />forth in this Sublease and to enforce any right which the Sub- <br />lessor has hereunder, in each instance with the same force and <br />effect as if the Authority or the Trustee itself had undertaken <br />to perform and discharge or enforce the same. <br />Section 9.5 The Authority and the Trustee, severally, <br />on behalf of the holders of the Bonds, shall possess, may exercise <br />and be suhrogated to all rights of the Sublessor hereunder to the <br />extent such possession and exercise are necessary to insure <br />compliance by Sublessee with the terms and provisions hereof. <br />if any of the events described in subparagraphs (a), (h), (c), <br />(d}, and (e) of Article XIII of the Lease shall occur and such <br />default shall be continuing, then at any time the Authority (or <br />the Trustee if an Event of Default shall have occurred under the <br />Resolution which is not corrected within the time permitted, i£ <br />any) may substitute itself or its nominee in place of the Sublessor <br />tinder is:iS Sublease. <br />Section 9.6 At the option of the Authority or the Trustee <br />(as assignee of the rights of Sublessor hereunder, as mortgagee of <br />the Project or as successor to the interest of Sublessor by <br />operation of law or any other agreement now existing or hereafter <br />a-ade) Sublessee agrees that neither the cancellation of the Lease <br />or the Sublease or any other ground or underlying lease to which <br />this Sublease is now or may hereafter become subject or subordinate <br />nor any foreclosure at a mortgage affecting the fee title to the <br />Project or any part thereof, nor the giving of a deed in lieu of <br />such foreclosure, nar the institutian of any suit, action, summary <br />or other groceeding by ,the Authority or the Trustee to recover posses- <br />sion of the Project or any part thereof, nor the institution of any <br />foreclosure groceeding with respect to the Project or any part <br />18 <br />
