~~~} ~VY~~°y11~ <br />A~.~.'1 ~'~+~` Si <br />Section 5.1 Sublessee shall, during the life of this <br />Sublease, bear, pay, and discharge or cause to be borne, paid, and <br />disc~,arged, before the delinquency thereof, all taxes and assess- <br />ments, general and special, if any, which may be lawfully taxed, <br />charged, levied, assessed, oz imposed upon or against or be pay- <br />able for or in respect of the Project or the revenues therefrom, <br />ar any part thereof, or any improvements at any time thereon or <br />Sublessor°s or Sublessee's interest in the Project under this <br />Sublease, including any new lawful taxes and assessments not of <br />the )rind enumerated above to the extent that the same are law- <br />fully made, levied, or assessed in lieu of or in addition to taxes <br />ar assessments now customarily levied against real property, and <br />further including all water and sewer charges, assessments, and <br />other governmental charges and impositions whatsoever, foreseen or <br />unforeseen, which if not paid when due would encumber Sublessor's <br />or the Authority's interest in the Project tali of the foregoing <br />being herein referred to as "Impositions"). Any Impositions due <br />and payable prior to the time Authority or Sublessor acquired its <br />interest in the Project shall be paid in full by Sublessee, and <br />in the event any special assessment taxes are levied and assessed <br />w€:±ch may be paid in installments, Sublessee shall be required to <br />gay only such installments thereof as become due and payable <br />during the life of this Sublease as and when the same become due <br />and payable. Sublessor agrees that at Sublessee's request, it <br />shall fully cooperate with Sublessee in all reasonable ways to <br />contest any such levy, charge, or assessment which Sublessee <br />determines to contest by approgriate proceedings. Sublessee shall <br />furnish to Sublessor, the Truskee, and the Authority evidence of <br />payment of any Imposition upon request. <br />Section 5.2 Sublessee shall not be required to pay any <br />imposition as provided in Section S.I, so long as the amount, <br />applicability, or validity thereof shall currently be contested <br />in good faith by appropriate proceedings in such manner as will <br />not result in loss, forfeiture, or material damage to the Project <br />11 <br />
