51:34~L EAS E This Sublease is made and entered into as of the first day of 3uly, 1979, by and between Region III Facilities Corpora- tion, a not-for-profit corporation existing under the Nebraska Non-Profit Corporation Act (the 'Sublessor"j, and, jointly and severally, the unnamed Interlocal Cooperation Act agency estab- lisped by the counties comprising Region 3 as described in Section 83-1,143.05 R.R.S. Neb. 1943, pursuant to an Agreement executed in 1971, as amended and currently in effect and Mid-Nebraska Mental Retardation Services, Inc., a Nebraska nonprofit corporation (referred to herein jointly and severally as the `Sublessee' and sometimes separately referred to as "constituents" of Sublessee). WITNESSETH: The Sublessor has-been formed for the purpose of acquir- ing real and personal property and leasing it to Sublessee and proposes to acquire by lease from Hospital Authority No. 1 of Hall County (the "Authority") a facility suitable for the treatment, including training and rehabilitation, of mentally ill, retarded, and disabled persons (the "Project") in Hall County, Nebraska, and desires to sublease the Project to Sublessee and Sublessee desires to sublease the Froject and operate it as such facility. Nt)1+I, THEREf'CRE, in consideration of the premises and the mutual covenants and agreements herein set forth, Sublessor and Sublessee do hereby covenant and agree as set forth hereinafter in this Lease Agreement, and for purposes of this Sublease, the words and phrases used herein shall have, unless the context requires a different meaning, the following meanings, to-wit: 1. "Act" means the Hospital Authori*_ies Act of the State of Nebraska, being Sections 23-343.74 to 23-343.120, inclusive, Reissue Revised Statutes of Nebraska, 1943, as amended, including any subsequent amendments to the Act. 2. 'Authority" shall mean Hospital Authority No. 1 of Hall County, Nebraska, organized and existing under the Act, governed by its Board of Trustees. 3. "Bond Fund" shall mean the fund established and held pursuant to Section 5.1 of the Resolution. 4. 'BOndB' shall mean the Series 1979 Bonds and any Completion Bonds or Refunding Bonds issued as permitted by the Resoiution.
