~i~~ig~~ <br />P_RTICLE XvIII <br />1tOTICES, INTERPRETATION At7D <br />EXPENSES OF AUTHORZTY <br />Section 38.1 All notices, demands and requests which <br />may ar are required to be given by either party tc the other <br />shall be in writing and ail such notices, demands or requests <br />shall be deemed duly served and delivered for all purposes (a) <br />upon the Authority, if delivered in person, to its duly qualified <br />and acting Chairman or Secretary or if a copy thereof be mailed, <br />by certified or registered mail, postage prepaid, addressed to <br />Hospital Authority PIa. 1 of Hall County, Nebraska, in care of the <br />County Clerk of Hall County, Courthouse, Grand Island, Nebraska <br />68801, or to such other address as Putharity may from time *_o <br />time designate in writing to Lessee; (b) upor. Lessee, if delivered <br />in person, to any executive officer of Lessee or if a copy thereof <br />be mailed, by certified or registered mail, postage prepaid, <br />addressed to C. Burnett-Terman, 831 Fast Phoenix, Grand Island, <br />Nebraska 68801, or to such other address as Lessee may from time <br />to time designate in writing; and (c) upon Region III if a copy <br />thereof be mailed, by certified or registered mail, postage <br />prepaid, addressed to Acid-Nebraska ~?ental Retardation Sexvices, <br />P.Q. Eox 1146; 522 Fast Side 3oulevard, I3astings, Pebraska 68901, <br />or such other address or Region III may from time to time designate <br />in writing. All notices given by certified or registered mail as <br />aforesaid shall be deemed duly given as of the date they are so <br />mailed. <br />Section 18.2 The Authority and Lessee shall each be <br />entitled to specific performance and injunctive or other equitable <br />relief for any breach or threatened breach of any of the provisions <br />of this Lease Agreement, notwithstanding the availability of an <br />adequate remedy at law, and each party hereby waives the right to <br />raise such defense in any proceeding in equity. The specific <br />remedies provided for in this Lease Fgreement are cumulative and <br />not exclusive of any other remedy. The failure of either party <br />- to insist in any one or more cases upon strict performance shall <br />nat be construed as a waiver or relinquishment for the future. <br />-37- <br />
