~ ~~~~~.~ <br />7, "Fiscal Year°' or "'dear" she'll mean t~Nae 12-month. <br />accounting period of Lessee. <br />"Project" shall mean the facility, including <br />building and related equipment to be used for the treat- <br />ment, including training and rehabilitation, of mentally <br />ill, retarded and disabled persons to be leased to the <br />*,essee and s*.ableased by Lessee for ope_ation by pegion <br />III and shalt ccnsist of the Site, the buildings and <br />improvements on such land and all furniture, machinery, <br />equipment and other personal property grovided for such <br />facility pursuant to the terms of this Lease Agreement <br />by the Authority and used in connection with such facil- <br />ity including all additions, replacements and substitutions <br />therefor but shall not include any tangible personal prop- <br />erty of Region III used in connection with such facility. <br />4. "Resolution" shall mean the Bond Resolution <br />duly gassed and adopted by the Board of '"rustees of the <br />Authority on Juiy 24, 1979, pursuant to which the <br />$340, 000 of 24edical Facility P,evenue Bonds, ??egion <br />III Facilities Corporation Issue, Series 1979, of <br />the Authority shall be issued. <br />10. ''Revenues"' shall mean all moneys, charges, in- <br />come, receipts, profits, rentals and returns of whatever <br />nature and howsoever derived from the Project. <br />11. "Region III" means jointly and severally the <br />unnamed Interlocal Cooperation .Act agQncy established <br />by the counties comprising Region 3 as described in <br />Section 83-1,143.06 £:. R.S. Neb. 1943, pursuant to <br />an Agreement executed in 1971, as amended and currently <br />in effect and Mid-Nebraska Mental Retardation Services, <br />Inc., a Nebraska non°profit corporation. Region III <br />is referred to in this Lease F.greement, from time <br />to time, as Sublessee under the Sublease. <br />12. "Site" shall mean the land described on Exhibit <br />A hereto. <br />13. "'Site Lease" sha31 mean that Site Lease dated <br />as of July i, I979, by and between Lessee, as lessor <br />and the Authority, as lessee, whereby the Putharity has <br />accruired the use and eniovment of the Site. <br />I4, "Sublease" shall mean that Sublease dated as of <br />July 1, 1979, by and between the Lessor and°.egion III <br />subletting the Project for operation by P.egion IZI. <br />15. "Trustee" shall mean the trustee appointed under <br />the Resolution and its successors in interest as trustee <br />under the Resolution. The initial Trustee is Commercial <br />National Bank & Trust Company, Grand Island, "tbraska. <br />16. "Underwriter" shall mean with respect to the <br />Series 1979 Bonds, Van Horne Services, Inc., and with <br />respect to any other Bonds, the original purchaser of <br />such Bonds. <br />-2- <br />
