"Project" shall mean the facility, including building and related equipment to be used for the treat- ment, including training and rehabilitation, of mentally ill, retarded and disabled persons to be leased to the *,essee and s*.ableased by Lessee for ope_ation by pegion III and shalt ccnsist of the Site, the buildings and improvements on such land and all furniture, machinery, equipment and other personal property grovided for such facility pursuant to the terms of this Lease Agreement by the Authority and used in connection with such facil- ity including all additions, replacements and substitutions therefor but shall not include any tangible personal prop- erty of Region III used in connection with such facility. 4. "Resolution" shall mean the Bond Resolution duly gassed and adopted by the Board of '"rustees of the Authority on Juiy 24, 1979, pursuant to which the $340, 000 of 24edical Facility P,evenue Bonds, ??egion III Facilities Corporation Issue, Series 1979, of the Authority shall be issued. 10. ''Revenues"' shall mean all moneys, charges, in- come, receipts, profits, rentals and returns of whatever nature and howsoever derived from the Project. 11. "Region III" means jointly and severally the unnamed Interlocal Cooperation .Act agQncy established by the counties comprising Region 3 as described in Section 83-1,143.06 £:. R.S. Neb. 1943, pursuant to an Agreement executed in 1971, as amended and currently in effect and Mid-Nebraska Mental Retardation Services, Inc., a Nebraska non°profit corporation. Region III is referred to in this Lease F.greement, from time to time, as Sublessee under the Sublease. 12. "Site" shall mean the land described on Exhibit A hereto. 13. "'Site Lease" sha31 mean that Site Lease dated as of July i, I979, by and between Lessee, as lessor and the Authority, as lessee, whereby the Putharity has accruired the use and eniovment of the Site. I4, "Sublease" shall mean that Sublease dated as of July 1, 1979, by and between the Lessor and°.egion III subletting the Project for operation by P.egion IZI. 15. "Trustee" shall mean the trustee appointed under the Resolution and its successors in interest as trustee under the Resolution. The initial Trustee is Commercial National Bank & Trust Company, Grand Island, "tbraska. 16. "Underwriter" shall mean with respect to the Series 1979 Bonds, Van Horne Services, Inc., and with respect to any other Bonds, the original purchaser of such Bonds. -2-
