Lessee expressly agrees and under- stands that nothing herein contained shall obligate P_uthority to purchase or pay for or become obligated for, and Lessee shall have no authority to obligate Authority to purchase or pay for, anything whatsoever out of funds other than those in the 1979 Construction Fund. Section 4.4 P.11 buildings, improvements, and works per- formed or in progress upon execution hereof and all work and materials located on the Site or ir. the Froject as the work pro- gresses or is completed and any equipment which under this Agree- went becomes or is deemed to be a part of the Project shall become the property of Authority immediately when erected or installed, except as is provided in Section 4.7 hereof. Section 4.5 Lessee hereby warrants that the construction and completion of the Project in accordance with the terms of this Lease Agreement will, together with any furniture, equipment. and ^ther ^~,-~^^~t nrpperty provided by Region III at its own expense, result in a facility for the treatment, including training and re- habilitation of mentally ill, retarded, and disabled persons, for use by Lessee and Region III. Lessee further covenants and agrees that it will provide from time to time (or cause to be provided) at its owr= expense and cause to be installed in the Project, all such furniture, equipment, and other personal property as may be necessary to assure that the Project becomes a fully operational __ facility as contemplated by the plans and specifications and this Agreement. Section 4.6 Lessee agrees that it shall require the general contracto. for construction of the Project to furnish a performance bond-and labor and materials payment bond in the full amount of such contract, made by the contractor as the principal -ll-
