~~ ARTZCL£ iV ACQIIISZTION OF PROJECT Section 4.1 Concurrently with the execution hereof, the partif_s have executed the Site Lease. On the Site the facility constituting, together with the Site, the Project will be con- structed. Section 4.2 The Authority agrees that the Project shall be constructed in accordance with the plans and specifications prepared by James L. Cannon and Associates, Architects, brand Island, :7ebraska, and the Authority agrees that payment for con- struction of the Project shall be made from the 1979 Construction { Fund established from a portion of the proceeds of the Series 1979 Bonds and from funds contributed by Lessee or Region ZZZ for that purpose pursuant to Section 4.5 hereof. The Authority shall have no obligation to pay for the Project other than from the proceeds of the Series 1979 Bonds and any Completion Bonds issued as per- mined by the Resolution. The Authority agrees to issue the Series 1979 Bonds in the total amount of $340,000 as provided by the Resolution. Section 4.3 Upon the execution hereof, Lessee sha13 be Construction Agent for the Authority, and as such Construction Agent shall take bids and execute a contract for the evn3tru~*_ion of the Project and cause said contract to be fully performed by the contractor thereunder in accordance with the terns thereof and Lessee covenants to cause the construction contemplated thereunder to be carried out in accordance with the terms of said contract. The parties further understand that after the execution hereofi it may be necessary to contract for the acquisition of other improve- ments or equipment constituting part of the Project to be paid from the 1979 Construction Fund, and the Authority agrees that Lessee as such Construction Agent, may award or cause to be awarded the necessary contracts thezefor. All contracts for construction shall be pursuant to the plans and specifications prepared by said Architects as approved by Lessee. Lessee agrees to fully enforce each and all of the terms and provisions of such contracts. As _10_
