<br /> <br />79® t~(~93~34 <br />a lien against the subject property, subject to the execution <br />date of this agreement, however, not to include liability for <br />the sewer assessments previously to in this agreement in <br />which the Buyers have assumed the obligation of. <br />If Buyers shall fail for ninety (90) days from due <br />date to make any payment or perform any agreement herein <br />con*_ained, or shall breach any of the covenants herein <br />contained, Sellers may at any time thereafter at Sellers <br />election, declare the full amount remaining unpaid on said <br />purchase price, together with unpaid interest, taxes, and <br />insurance premiums to be immediately due and payable. The <br />Sellers may further, at their option, at any time after such <br />failure, consider and treat this contract as void, and may <br />consider and treat the Buyers as their tenants, fialding <br />aver without permission after the expiration of said ninety <br />(90) day term. Action by the Sellers upon said breach may <br />be taken only after a notice of said breach has been given <br />to the Buyers b~ registered letter at the adress of the <br />location of the said property subject to this agreement. <br />It is agreed that time is of the essence in this <br />contract and it shall be so construed by all Courts, and <br />no waiver of time or manner of performance shall be implied, <br />or alleged to excuse a failure and performance thereof, unless <br />such waiver be in writing, signed by the person against whom <br />it is implied or alleged. <br />Zt is agreed that any notice required to be served <br />upon the Buyers in connection with this contract shall be <br />done by registered mail, return receipt requested, and the <br />same shall be enclosed in a sealed envelope and postage <br />fully paid, addressed to the Buyers of the premises herein <br />described and then deposited in any Post Office in the United <br />States, duly registered in accordance with the terms and <br />practices of the United States Post Office Department. <br />Ali of the .foregoing stipulations shall apply to and <br />hind the heirs, executors, administrators, and assignees of <br />the respective Sellers acid Buyers herein. <br />
