<br />79-- (~~~~r~~ <br />along 13th Street whexe it abuts said subdivision. <br />2. Sanitary Sewer. The Subdivider agrees to construct <br />sanitary sewer service mains in accordance with plans and specifications <br />approved by the City's Director of Public Works to serve all lots within <br />said subdivision, subject to inspection by the City. In the alternative, <br />the Subdivider may petition for construction of any and all necessary <br />.sanitary sewer service mains. The Subdivider agrees to connect any and <br />all structures within said subdivision to said sanitary sewer service <br />prior to the issuance of any occupancy permits. <br />3. Water. City water service is available to all lots within <br />said subdivision. The Subdivider agrees to connect all structures <br />within said subdivision to said water mains prior to the issuance of <br />any and all occupancy permits. Furthermore, the Subdivider agrees to <br />pay any and all connection charges for said water service prior to <br />connection. <br />4. Drainage. The Subdivider agrees to grade all lots in <br />said subdivision in accordance with the structures located thereon <br />so that storm water flow drains to public right-of-way. In the alter- <br />native, the Subdivider may grade ail lots in such a manner so that <br />storm water flows to Detention Cell No. 5, provided that such plans for <br />drainage are approved by the City's Director of Public Works. <br />5. Sidewalks. The Subdivider, if still the owner of the land <br />in the proposed subdivision, or if the Subdivider shall have transferred <br />title to the property, then the various grantees thereof, will install, <br />at their own expense, ail public sidewalks required by the Grand Island <br />City Code when the adjacent lot is built upon, and sidewalks shall be <br />regulated and required with "the building permit far each such lot. <br />6. Warranty. The undersigned owner, as Subdivider, warrants <br />that it is the owner in fee simple of the land described and proposed to <br />be known as Calvary Subdivision, and that an abstract of title will be <br />submitted for examination, if necessary, upon request of the City of <br />Grand Island. <br />7. This agreement shall run with the land and shall be binding <br />upon aad inure to the benefit of the parties hereto, their successors, <br />- 2 - <br />
