7s- vu52 SUBDIVISION AGREEMENT CALVARY SUBDIVISION In the City of Grand Island, Nebraska Calvary Lutheran Church, hereinafter called the Subdivider, as owner of a tract of land comprising a part of the Southeast Quarter of the Southwest Quarter (SE%,SW~) of Section Eight (8), Township Eleven (11) North, Range Nine (9)-West of the 6th P.M., Hall County, Nebraska, more particularly described as follows: Beginning at a point 33 feet North and 33 feet LJest of the Southeast Corner of the Southeast Quarter of the Southwest Quarter of said Section Eight ($); thence running westerly bearing N 89° 42' 16" W parallel to the South line of said Section Eight (8) for a distance of 282 feet; thence running northerly bearing N 0° 00' 00" E parallel to the East line of said Southeast Ouarter of the Southwest Quarter (SE~SW3) for ~ distance of 482.35 feet; thence running east bearing S 89 37' S4" E for a.distance of 282 feet; thence running South on a line parallel to and 33 feet Nest of the East line of said Southeast Quarter of the Southwest Quarter (SE~SW~) for a distance of 482 feet to the point of beginn- ing, said tract containing 3.12 acres, more or less desires to have subdivided as a subdivision the above described tract of land which is located within the corporate limits of the City of Grand Island, Nebraska, and hereby submit to the City Council of such City for acceptance as provided by law an accurate map and plat of such proposed subdivision, to be known as Calvary Subdivision, designating explicitly the land to be laid out and particularly describing the lots and ease- ments belonging to such subdivision, with lots designated by numbers and easements by dimensions, and proposes to cause the plat of such subdivision when finally approved by the Regional Planning Commission and the City Council to be acknowledged by such owner, certified as to accuracy of survey by a registered land surveyor, and to contain a dedication of the easements to the use and henefit of p~~blic utilities. In consideration of the acceptance of the plat of said Calvary Subdivision, the Subdivider hereby consents and agrees with the City of Grand Island, Nebraska, that it will install or provide at its expense the following improvements: 1. Paving. Howard Place and Custer Avenue where they abut said subdivision have been paved. The Subdivider agrees that any and all assessments for the aforementioned paving shall be proportionately divided among all lots within said subdivision.
