7s- vu52 <br />SUBDIVISION AGREEMENT <br />CALVARY SUBDIVISION <br />In the City of Grand Island, Nebraska <br />Calvary Lutheran Church, hereinafter called the Subdivider, <br />as owner of a tract of land comprising a part of the Southeast Quarter <br />of the Southwest Quarter (SE%,SW~) of Section Eight (8), Township Eleven <br />(11) North, Range Nine (9)-West of the 6th P.M., Hall County, Nebraska, <br />more particularly described as follows: <br />Beginning at a point 33 feet North and 33 feet LJest of the <br />Southeast Corner of the Southeast Quarter of the Southwest <br />Quarter of said Section Eight ($); thence running westerly <br />bearing N 89° 42' 16" W parallel to the South line of said <br />Section Eight (8) for a distance of 282 feet; thence running <br />northerly bearing N 0° 00' 00" E parallel to the East line <br />of said Southeast Ouarter of the Southwest Quarter (SE~SW3) <br />for ~ distance of 482.35 feet; thence running east bearing <br />S 89 37' S4" E for a.distance of 282 feet; thence running <br />South on a line parallel to and 33 feet Nest of the East <br />line of said Southeast Quarter of the Southwest Quarter <br />(SE~SW~) for a distance of 482 feet to the point of beginn- <br />ing, said tract containing 3.12 acres, more or less <br />desires to have subdivided as a subdivision the above described tract <br />of land which is located within the corporate limits of the City of Grand <br />Island, Nebraska, and hereby submit to the City Council of such City for <br />acceptance as provided by law an accurate map and plat of such proposed <br />subdivision, to be known as Calvary Subdivision, designating explicitly <br />the land to be laid out and particularly describing the lots and ease- <br />ments belonging to such subdivision, with lots designated by numbers <br />and easements by dimensions, and proposes to cause the plat of such <br />subdivision when finally approved by the Regional Planning Commission and <br />the City Council to be acknowledged by such owner, certified as to accuracy <br />of survey by a registered land surveyor, and to contain a dedication of <br />the easements to the use and henefit of p~~blic utilities. In consideration <br />of the acceptance of the plat of said Calvary Subdivision, the Subdivider <br />hereby consents and agrees with the City of Grand Island, Nebraska, that <br />it will install or provide at its expense the following improvements: <br />1. Paving. Howard Place and Custer Avenue where they abut <br />said subdivision have been paved. The Subdivider agrees that any and <br />all assessments for the aforementioned paving shall be proportionately <br />divided among all lots within said subdivision.
