1. Paving. No additional paving of public right-of-way is required. The Subdivider agrees to pay any and ail assessments against said property as a result of public right-of-way improvements. 2. Water and Sewer. tJater and sanitary sewer service is avail- able to all lots within said subdivision, subject to an assessment charge. 3. Drainage. The Subdivider agrees to grade all lots in said 'subdivision in conjunction with the structures located thereon so that storm water drains to public right-of-way or to the drainage easement located on the westerly edge of Lot One {1) of said subdivision. 4. Flood Hazard. All structures shall have the lawest floor elevation to a minimum of one foot above the elevation of the 100-year flood, as determined by the building permit received by the Subdivider or successors from the building permit received by the Subdivider or successors from the building department of the City of Grand Island under the provisions of Section 2-1506.06, R.R.S. 143. No b;~sement shall be constructed in connection with any structure in the subdivision. S. Warranty. The undersigned owner, as Subdivider, warrants that she is the owner in fee simple of the land described and proposed to be known as tic Govern Subdivision, and that an abstract of title will be submitted for examination, if necessary, upon request of the City of Grand Island. 6. This agreement shall run with the land and shall be binding upon and inure to the benefit of the parties hereto, their successors, assigns, heirs, devisees, and legatees. Where the term "Subdividers" is used in this agreement, the subsequent owners of any lots in the subdivision shall be responsible to perform any of *_he conditions of this agreement if the Subdivider has not performed such conditions.
