<br />1. Sanitary Sewer, Sanitary sewer service is available to all <br />lots within said subdivision, subject to any and all connection fees, <br />or assessments. <br />2. Water. No public water service is available to the lots of <br />-said subdivision. Accordingly, the City hereby authorizes the use of <br />,private wells within said subdivision. The Subdividers waive the right <br />to protest any and all water main districts created within said sub- <br />division and to connect all structures within said subdivision to said <br />water main within one year after said water main becomes available. <br />3. Paving. The Subdividers agree to waive their right to protest <br />any and all repaving districts upon Webb Baad where it abuts said <br />subdivision. <br />4. Drainage. The Subdividers agree to grade all lots in said <br />subdivision in conjunction with the structures thereon so that storm <br />water drains to public right-of-way. <br />5. Sidewalks. the Subdividers, if still the owners of the land <br />in the proposed subdivision, or if the Subdividers shall have trans- <br />ferred title to the property, then the various grantees thereof, will <br />install, at their own expense, all public sidewalks required by the <br />Grand lsland C'it~~ Code when the adjacent lot is built upon, and side- <br />walks shall be regulated and required with the building permit for each <br />such iot. <br />b. Warranty. The undersigned owners, as Subdividers, warrant <br />that they are the owners in fee simple of the land described and pro- <br />posed to be known as Lepant Subdivision, and that an abstract of title <br />will be submitted far exaruination, if necessary, upon request of the <br />City of Grand lsland. <br />7. This agreement shall run with the land and shall be binding <br />upon and inure to the benefit of the parties hereto, their successors, <br />assigns, heirs, devisees, and legatees. <br />- 2 - <br />
