1. Sanitary Sewer, Sanitary sewer service is available to all lots within said subdivision, subject to any and all connection fees, or assessments. 2. Water. No public water service is available to the lots of -said subdivision. Accordingly, the City hereby authorizes the use of ,private wells within said subdivision. The Subdividers waive the right to protest any and all water main districts created within said sub- division and to connect all structures within said subdivision to said water main within one year after said water main becomes available. 3. Paving. The Subdividers agree to waive their right to protest any and all repaving districts upon Webb Baad where it abuts said subdivision. 4. Drainage. The Subdividers agree to grade all lots in said subdivision in conjunction with the structures thereon so that storm water drains to public right-of-way. 5. Sidewalks. the Subdividers, if still the owners of the land in the proposed subdivision, or if the Subdividers shall have trans- ferred title to the property, then the various grantees thereof, will install, at their own expense, all public sidewalks required by the Grand lsland C'it~~ Code when the adjacent lot is built upon, and side- walks shall be regulated and required with the building permit for each such iot. b. Warranty. The undersigned owners, as Subdividers, warrant that they are the owners in fee simple of the land described and pro- posed to be known as Lepant Subdivision, and that an abstract of title will be submitted far exaruination, if necessary, upon request of the City of Grand lsland. 7. This agreement shall run with the land and shall be binding upon and inure to the benefit of the parties hereto, their successors, assigns, heirs, devisees, and legatees. - 2 -
