79--; UU2~1U - 2 - NOW, THERF~'ORE, the Government does hereby quitclaim and release from all conditions, reservations and restrictions of the aforementioned Quitclaim Deeds the following described property, to wit: A-tract of land comprising the West Half of the Northeast Quarter of the Sautheast Quarter (W~Ng~SEy), and the East Half of the Northwest Quarter of the Southeast Quarter (E~NWySE~), all in Section Thirty Four (34}, Township Twelve (12) North, Range Nine (9) West of the bth P.M. in Hall County, Nebraska, more particularly described as follows: Beginning at the Northeast corner of said W~NEySE~; thence southerly along the East line of said W~NE~SE~, a distance of One Thousand Three Hundred Fourteen and Seventy Eight Hundredths (1,314.7$) feet, to the Southeast corner of said W~NE~SEy; thence westerly along the South Line of said W'~NE~SE~ and the South line of said E'-~NW'~SE'~, a distance of One Thousand Three Hundred Twenty One and Sixty Three Hundredths (1,321.63) feet, to the Southwest corner of said E'~NW~SE~; thence northerly along the West Iine of said E~NW~;SE~, a distance of One Thousand Three Hundred Thirteen and Nine Tenths (1,313.9) feet, to the Northwest corner of said E~NW3~SE~y; thence easterly along the North line of said E~NSJySEi and the North line of said W~NE'ySE~, a distance of One Thousand Three Hundred Twenty One and Eight Tenths {1,321.8) feet to the place of beginning and containing 39.617 acres more or Less. PROBiDED, HOw~VER, and it shall be a condition hereof, that the County will include in any instrument of transfer conveying title to the area which is herein released from all obligations and restrictions of said Quitclaim Deeds the following provisions: 1) That the Grantor, County of Hall, Nebraska, reserves unto itself, its successors and assigns, for the use and benefit of the public a right of flight for the passage of aircraft in the airspace above the surface of the real property herein described, together with the right to cause in said airspace such noise as may be inherent in the operation of aircraft, now knocm or hereafter used, for navigation of or flight in the said airspace, and for use of said airspace for landing on, taking off from, or operating on the Hall County Regional Airport. 2) That the Grantee expressly agress for itself, its successors and assigns, io prevent any use of the herein described real property which would interfere with landing or taking off of aircraft at the Hall County Regional Airport, or otherwise constitute an airport hazard.
