~g-~c~ ~: ~ ~ ~~ <br />home, tent, garage, s ck, or unsightly outbuilding shall be use6 <br />in said Subdivision as a dwelling at anytime, nor shall any type <br />structure of a temporary character be used as a residence. <br />10. Lot 1 may be used to keep up to six head of horses and <br />up to two head of cattle and the necessary buildings for them may <br />be constructed. No other animals, including hogs, chickens, <br />rabbits, other livestock shall be kept or maintained on Lot 1 <br />other than household pets be kept on said Lot, and household pets <br />shall not be kept, placed or maintained for any commercial purpose. <br />The owner of said Lot shall not maintzin more than two household <br />gets for family use only. All household pets which could be <br />contained by fences must be kept within fenced enclosures. <br />11. No sod, earth, sand, gravel or trees shall be removed <br />to injury of the value of or appearance of said Lot 1 and no <br />unused building material, junk or rubbish shall be left exposed <br />on said Lot, except during actual building operations. <br />12. No sign of any kind ar billboards shall be displayed to <br />the public view on said Lot 1, except one (1} sign of not more <br />than five feet (5') square advertising the property for sale or <br />rent, or signs used by a builder to advertise the property during <br />the construction and sales period. <br />13. No warn out or discarded automobiles, trucks, machinery <br />or parts thereof shall be stored on said Lot 1 and no portion of <br />said Lot ah~ll be used for junk piles or the storage of any king <br />of junk or waste material. <br />14. All vehicles kept or stored on said Lot 1 shall be <br />licensed taxed, and in regular use or they shall not be allowed <br />to remain on said Lot. <br />15. These Covenants, Restrictions and Conditions are to run <br />with the land and shall be binding on all persons and all parties <br />claiming ownership of said Lot 1 until June let, 1947, at which <br />time said Covenants, Restrictions and Conditions shall be automatically <br />extended for successive periods of ten (10) years, unless changed <br />or modified by a vote of a majority of the then owners of the <br />lots in said Subdivision. <br />i6. Zf any owner of said Lot 1 or their heirs or assigns <br />shall_ violate or attempt to violate any of the covenants, Restrictions <br />and Conditions herein set forth, it shall be lawful for any other <br />person or persons owning any real estate in said Subdivision to <br />prosecute such proceedings at law or in equity against the perm <br />or persons violating or attemptincl to violate any such Covenants, <br />Restrictions and Conditions and to prevent him, her or them from <br />sa Bring or to recover damages for such violations. The owners <br />of Lots 2, 3, A, S, 6 and 7 shall be entitled to the protection <br />of this Agreement even though those Lots are not restricted by <br />this Agreement. <br />1'F. Zf any of the Covenants, Restrictions or Conditions <br />herein set forth are violated and declared void by a Court of <br />competent jurisdiction, the remaining Covenants, Restrictions and <br />Conditions shall not b® affected but shall stay and remain i» <br />full force and effect. <br />18. This Agreement and the faithful performance of the <br />terms thereof shall be binding upon the heirs, administrators, <br />executors, assigns, grantees and devisees of the parties to thi$ <br />Contract, and open the purchaser or purchasers of said Lot 1. <br />-2- <br />
