79-ii~-.2 ~ ~4. <br />AGREEMENT FOR PROTECTIVE COVENANTS, RESTRICTIONS <br />AND CONDITIONS FOR SHADY LANE SUBDIVISION <br />LOCATED IN HALL COUNTY, NEBRASKA <br />KNOW ALL MEN BY THESE PRESENTS: <br />WHEREAS, GERALD D. FREDERIKSEN and L. JUNE FREDERIKSEN, <br />husband and wife, are the owners of all lots in Shady Lane Subdivision, <br />a Subdivision located in the South Half of the Southeast Quarter <br />(S~SE~t) of Section Fourteen (14), Township Eleven (11) North, <br />Range Nine (9), West of the 6th P.M., in Hall County, Nebraska as <br />more specifically described in the plat of said Subdivision; and <br />WHEREAS, it is the desire of the aforesaid owners of said <br />Subdivision to improve Shady Lane G::bdivision by encouraging the <br />sale of lots and construction of modern and desirable dwelling <br />houses; <br />NOW, WHEREFORE, in consideration thereof, and of the mutual <br />benefits to be derived by the owners of said Subdivision, and any <br />purchaser or purchasers, their heirs, administrators, executors <br />and assigns, the owners stipulate and agree that Lot 1 in said <br />Subdivision, shall be and is subject to the following Protective <br />Covenants, Restrictions and Conditions, all of which shall run <br />with the land, as follows: <br />1. Lot 1 in the Subdivision shall be known and described <br />as a residential Iot. <br />2. Lot 1 will have no more than one dwelling unit thereon <br />and. such dwelling will meet the following minimum square feet <br />requirements: <br />(A) If one story, not less than 1,200 square feet of <br />living space, excluding garage. <br />{g} If two story, not less than 1,200 square feet of <br />living space on first floor, excluding garage. <br />3. No apartment house, duglex or triplex shall be built on <br />Lat 1, nor shall any basement house be built on said Lot 1. Na <br />structure shall be erected, altered, glared or permitted to <br />remain on said Lot l other than any existing buildings arx; one <br />dwelling and a garage for no more than three cars. No dwelling <br />ar other building shall exceed two stories in height above <br />ground level, except existing buildings. <br />Q. No dwelling shall be erected £ar occupancy for more <br />than one family, nor shall any dwelling be used for occug4incy for <br />more than one family. No commercial or business enterprises <br />shall ire maintained, conducted or operated in or on said Lot 1. <br />5. Said Lot 1 shall not be divided or split to create <br />smaller building sites. <br />6. Rll garages shall be two car garages and any garage <br />building shall be constructed of the same material and quality <br />construction as the outside finish and roof of the main dwelling <br />structure. <br />7. All dwelling fronts and any other building fronts shall <br />be set back from the front lot line of said Subdivision a distance <br />of at least forty feet (40'). There shall be a side line set <br />back of any dwelling or other building of at least fifteen feet <br />(15') from any side _ot line. <br />8.
